AMENDMENT NO.1 TO ECONOMIC DEVELOPMENT SERVICES AGREEMENT ThIS IS Amendment No 1 to the EconomIc Development ServIces Agreement (the "Agreement") between the CIty of San Marcos, Texas (the "CIty"), a Texas munIcIpal corporatIOn, and MargIe V Moore, d/b/a the Global Marketeer Group ("GMG"), a Texas propnetorshIp RECITALS 1 The CIty CounCIl on October 4, 2005 adopted a resolutIOn approvIllg the Agreement. 2 EconomIc resolutIOn DIrector The CIty CouncIl, as part of the Agreement, reqUIred GMG to hIre a full-tIme Development Director, and on October 18, 2005, the CIty CounCIl adopted a approvIllg the hmng by GMG of Mr Jim Aanstoos as EconomIc Development 3 The salary and benefits approved by the CIty CouncIl for the EconomIc Development DIrector reqUIre that an amendment be made to the Agreement. Amendment The CIty and GMG agree to amend the Agreement as follows 1) A new SectIOn 3.A of the Agreement IS amended as follows (underlIllIllg IlldIcates added text; overstrike IlldIcates deleted text) A. Payments. The CIty wIll pay to GMG an amount not to exceed $244,795 $238,295 III each of the first two years of thIs Agreement for GMG's servIces proVIded under thIs Agreement. The CIty wIll make payments to GMG as follows 1 GMG wIll submIt to the CIty and to the Board no later than the 15th day of each month an ItemIzed IllVOlce describIllg GMG's expendItures under thIS Agreement for the prevIOUS month for reVIew and approval by the Board. Each IllVOlce wIll be III an amount that does not exceed $20,399.58 $19,857.92. In addItIOn to such IllVOlces, GMG may submIt a one-tIme IllVOlce for movIllg expenses for the EconomIc Development DIrector's relocatIOn to the CIty III an amount that does not exceed $2,500. 2 The Board wIll approve, dIsapprove, or approve WIth modIficatIOns each IllVOlce wIthIll 15 days of receIpt from GMG GMG may resubmIt, WIth
