<br />Regular Meeting <br /> <br />November 15, 2005 <br /> <br />39. <br />Page 5 <br /> <br />I <br /> <br />Thomaides inquired whether the driver of a vehicle would be ticketed if any <br />items in the bed of his truck blew out Police Chief Williams stated a <br />driver can be ticketed for items blowing out of the bed of a truck Mr <br />Diaz stated he supports the amendment because he believes an animal is the <br />property of the owner and they should be responsible for their property <br />On roll call for the amendment the following vote was recorded <br /> <br />AYE <br /> <br />Diaz, Guerrero and Taylor <br /> <br />NAY <br /> <br />Mihalkanin, Narvaiz, Thomaides and Bose <br /> <br />ABSTAIN <br /> <br />None <br /> <br />The motion for amendment failed Mayor Narvaiz inquired whether the Animal <br />Control Department has received any feedback from the Veterinarians in San <br />Marcos Mark Brinkley, Director of Environmental Health, stated he <br />provided the local Veterinarians with email addresses as the Council Mr <br />Guerrero inquired as to the action a Police Officer would take if they saw <br />an animal in danger Chief Williams stated if a Police Officer saw someone <br />driving recklessly with an animal in the bed of a pickup, they could be <br />ticketed for cruelty to animals He stated if the new Ordinance is <br />adopted, there would need to be some education and the violators would <br />first receive a verbal warning before ticketed On roll call for approval <br />of the Ordinance on second reading, the following vote was recorded <br /> <br />I <br /> <br />AYE <br /> <br />Mihalkanin, Narvaiz, Thomaides and Bose <br /> <br />NAY <br /> <br />Diaz, Guerrero and Taylor <br /> <br />ABSTAIN <br /> <br />None <br /> <br />Mayor Narvaiz introduced for consideration Item IS, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />NOMINATING THE CFAN EXPANSION PROJECT IN THE CITY AS AN ENTERPRISE <br />PROJECT UNDER THE TEXAS ENTERPRISE ZONE <br /> <br />I <br /> <br />Mr Taylor moved for adoption of the Resolution with amendments, and Mr <br />Diaz seconded the motion Mr O'Leary stated CFAN is a manufacturer of <br />aerospace fan blades, and is expanding their existing San Marcos operation <br />The company has plans to create additional jobs in the San Marcos <br />community He stated the purpose of the Resolution is to nominate CFAN as <br />a Texas Enterprise Project under the Texas Enterprise Zone Program, which <br />provides State sales and use tax benefits to targeted businesses The EZ <br />Program was designed to encourage job creation and capital investment in <br />
