<br />water facIlItIes. <br /> <br />4 The Applicant's petition mcludes a request for annexation ofthe Property <br /> <br />I <br /> <br />5 The CIty staff has IdentIfied conditions that need to be fulfilled or complIed WIth m <br />connection with this request, as described in Part 1 below, and the CIty Council WIshes to associate <br />these condItIOns WIth the approval of the Petitioner's petItIOn. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br /> <br />PART 1 The ApplIcant's petItIon for extensIOn of the CIty'S water and wastewater system <br />mains to serve the Property is approved, subject to the followmg condItIons <br /> <br />A. The extensions and all associated eqUIpment, facilities and appurtenances must be <br />constructed at the sole expense of the Applicant (subject to the CIty'S polICIes on oversizing). <br /> <br />B The extensIOns and all assocIated equipment, facilities and appurtenances must be <br />constructed m accordance WIth the CIty'S Technical Construction Standards and Specifications, <br />the provIsions of Chapter 86 of the CIty Code, and all other applicable City regulations and <br />standards. <br /> <br />C The ApplIcant must demonstrate, through engmeenng mformatIon submitted to and <br />approved by the DIrector of the Water and Wastewater Department, that adequate water supply <br />and water and wastewater line capacity is available in connection with any development or I <br />subdIVIsIOn plat proposed for the Property SIgmficant City utIlity improvement projects may <br />need to be completed before thIS supply and capacIty wIll be avaIlable. <br /> <br />D The ApplIcant must fully comply WIth all applIcable land development regulatIOns, <br />mcludmg WIthout lImItatIOn, the CIty'S Land Development Code <br /> <br />PART 2. The Applicant's petition for annexation of the Property is approved, and the City <br />staff IS dIrected to proceed to prepare a proposed servIce plan for the annexatIOn of the Property <br /> <br />PART 3 ThIS ResolutIOn shall be m full force and effect from and after its passage.
