<br />I <br /> <br />I <br /> <br />I <br /> <br />FacIhties to any CIty FacilItIes other than the Poles unless the LIcensee executes a separate <br />agreement With the CIty The LIcensee may make Attachments to drop poles and 11ft poles <br />located on a customer's property pnor to submIttmg an apphcatIOn and obtammg a permIt, <br />provIded the LIcensee submIts an apphcatIOn and obtams a permIt for the Attachments wIthm 30 <br />days of attachmg to the pole. <br /> <br />6 02 ConsIstent WIth apphcable law, the overlasillng of an eXIstmg Attachment of the LIcensee <br />by any person other than the LIcensee IS consIdered a separate Attachment requmng a separate <br />agreement wIth the CIty and a separate PermIt. Without such a PermIt, thud party overlashmg <br />constitutes an unauthonzed Attachment. The Licensee wIll not permIt any third party <br />overlashmg of the LIcensee's FacIhties wIthout obtammg wrItten venficatIOn from the City that <br />the overlashmg has been authonzed by the CIty <br /> <br />603 ConsIstent WIth apphcable law, the overlashmg by the LIcensee of ItS own facIhtIes IS not <br />consIdered a separate Attachment and IS not subJect to a separate PermIt, but the Licensee WIll <br />provIde the City wIth pnor wrItten notIficatIOn of any overlashmg the LIcensee mtends to <br />perform. The LIcensee wIll have a regIstered professIOnal engmeer certIfy that the overlashmg <br />can be accomphshed m complIance wIth the TechnIcal SpecIficatIOns and the Apphcable <br />Standards. <br /> <br />6 04 As part of the PermIt apphcation process, the CIty may reqUIre the LIcensee to have a <br />regIstered professional engmeer conduct a Pre-PermIt Survey and certify that the LIcensee's <br />proposed Attachments can be mstalled on the Poles m comphance with the TechnIcal <br />SpecIficatIOns and the Apphcable Standards. The selectIOn of the engmeer IS subJect to approval <br />by the City The engmeer's expenence must mclude SImIlar work on electnc utIhty systems. <br /> <br />605 Upon receIpt of a properly completed apphcatIOn, mcludmg any reqUIred Pre-PermIt <br />Survey, the CIty will reVIew the apphcatIOn wIthm a reasonable penod of time, and dISCUSS any <br />Issues with the LIcensee, mcludmg engmeenng or Make-Ready Work reqUIrements associated <br />WIth the apphcatIOn. The CIty'S acceptance of apphcatIOn documents or Issuance of a PermIt <br />WIll not reheve the engmeer or the LIcensee of full responsibIhty for the safe and proper <br />mstallatIOn of the Attachments covered by the PermIt. <br /> <br />606 If the City determmes that Make-Ready Work IS reqUIred to accommodate any Attachment <br />of the LIcensee, the CIty or ItS contractors WIll perform the work m accordance With ArtIcle 7 <br /> <br />6 07 If the CIty receIves Permit ApphcatIOns for the same Pole from the LIcensee and one or <br />more Other LIcensees wIthm 30 days of one another, and accommodatmg the requests may <br />reqUIre replacement or modIficatIOn of the Pole or rearrangement of eXIsting Attachments, the <br />CIty wIll follow the procedures of ArtIcle 9 m revlewmg the apphcatIOns. <br /> <br />608 If the LIcensee has not pre-paid the CIty for Make-Ready Work assOCIated WIth an <br />apphcatIOn, then upon completIon of the Make-Ready Work, the CIty wIll bIll the LIcensee for <br />all costs of the work. The CIty Will Issue a PermIt only after the Licensee pays the CIty all fees <br /> <br />8 <br />
