4. Cable service means: <br />a. The one -way transmission to customers of: <br />1. video programming provided by, or comparable to video programming provided <br />by, a television broadcast station; or <br />2. other programming services, by which is meant video, audio, or data information <br />that Grande makes generally available to all customers, to the extent the services are <br />deemed to be "cable service" under federal law; and <br />b. Customer interactive (two -way) transmissions required for the selection or use of video <br />programming or other programming services (such as, for example, customers' accessing and <br />utilization of data bases, the Internet, video game services, or other services), to the extent <br />they are "cable service" under federal law. <br />5. City Facilities means the electric distribution system facilities and equipment owned or <br />controlled by the City, including the Poles. <br />6. Communications Service means the provision of Telecommunications Service or Cable <br />Service over wire, cable, fiber owned by ATC or wireless facilities utilizing Attachments to the <br />Poles. <br />7. Conduit System means the underground conduit, Innerduct, manholes, vaults, risers, pull - <br />boxes and trenches of the City's electric utility system. <br />8. Distributed Antenna System or DAS Network means the Licensee's network of spatially <br />separated antenna nodes and Licensee's Facilities connected via fiber optic cable to provide wireless <br />services located in the City of San Marcos public rights -of -way within the geographic area depicted <br />in Exhibit A in the Right of Way License Agreement between City and Licensee, as amended from <br />time to time. <br />9. Licensee's Facilities means all of the Licensee's Attachments and all other antenna nodes, <br />fiber optic cables, wires and Associated Equipment used by the Licensee in the City to provide <br />Telecommunications Service. <br />10. Make -Ready Work means all work on the City Facilities required to accommodate the <br />Licensee's Attachments or to comply with all of the Applicable Standards. Make -Ready Work <br />includes, but is not limited to, rearrangement or transfer of existing Attachments, inspections, <br />engineering work, permitting work, tree trimming, and the installation, upgrade, strengthening, or <br />replacement of Poles. <br />11. Other Licensee means a person or entity other than the Licensee with which the City has <br />executed a license agreement to place Attachments on the Poles. <br />12.
