ARTICLE 6. PERMIT APPLICATION PROCEDURES <br />Section 6.01. The Licensee will not install any Attachments on any Pole without first applying for <br />and obtaining a Permit from the City's Public Services Department- Electric Utility Division by <br />completing the Application for Permit and Pole Contacts ( "Application ") in the form attached as <br />Appendix C. The Licensee will not occupy or attach the Licensee's Facilities to any City Facilities <br />other than the Poles unless the Licensee executes a separate Permit with the City. <br />Section 6.02. Consistent with applicable law, the overlashing of an existing Attachment of the <br />Licensee by any person other than the Licensee is considered a separate Attachment requiring a <br />separate agreement with the City and a separate Permit. Without such a Permit, third party <br />overlashing constitutes an unauthorized Attachment. The Licensee will not permit any third party <br />overlashing of the Licensee's Facilities without obtaining written verification from the City that the <br />overlashing has been authorized by the City. <br />Section 6.03. Consistent with applicable law, the overlashing by the Licensee of its own facilities is <br />not considered a separate Attachment and is not subject to a separate Permit, but the Licensee will <br />provide the City with prior written notification of any overlashing the Licensee intends to perform. <br />The Licensee will have a registered professional engineer certify that the overlashing can be <br />accomplished in compliance with the Technical Specifications and the Applicable Standards. <br />Section 6.04. As part of the Permit application process, the City may require the Licensee to have a <br />registered professional engineer conduct a Pre - Permit Survey and certify that the Licensee's <br />proposed Attachments can be installed on the Poles in compliance with the Technical Specifications <br />and the Applicable Standards. The selection of the engineer is subject to approval by the City. The <br />engineer's experience must include similar work on electric utility systems. <br />Section 6.05. Upon receipt of a properly completed Application, including any required Pre - Permit <br />Survey, the City will review the Application within a reasonable period of time, and discuss any <br />issues with the Licensee, including engineering or Make -Ready Work requirements associated with <br />the Application. The City's acceptance of application documents or issuance of a Permit will not <br />relieve the engineer or the Licensee of full responsibility for the safe and proper installation of the <br />Attachments covered by the Permit. <br />Section 6.06. If the City determines that Make -Ready Work is required to accommodate any <br />Attachment of the Licensee, the City, at its option, may perform Make -Ready Work on any or all <br />Poles associated with an Application under Article 7. City will notify Licensee in writing five (5) <br />business days from receipt of Application whether City will perform the Make -Ready Work. If City <br />opts not to perform Make -Ready Work, Licensee or its contractor will perform such Make -Ready <br />Work. <br />Section 6.07.
