<br />Regular Meeting <br /> <br />December 14, 2005 <br /> <br />139. <br />Page 9 <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />I speak 1) Gary Freemen stated he is the owner of Lavish Limos and is <br />present to answer any questions Mayor Narvaiz asked if anyone else wished <br />to speak No one did, so Mayor Narvaiz closed the public hearing Mr <br />Guerrero moved for adoption of the Resolution, and Mr Thomaides seconded <br />the motion Mr Jones inquired as to Mr Freeman's experience Mr <br />Freeman stated he currently owns a towing company and all his tow trucks <br />have a backseat so they can transport families while their vehicle is being <br />towed He stated he bought his business from a previous limousine company <br />located in San Marcos The Council then voted unanimously for adoption of <br />the Resolution <br /> <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE 2005-2006 CITY BUDGET TO PROVIDE FUNDING FOR REPAIRS TO <br />RIO VISTA DAM; AND DECLARING AN EMERGENCY <br /> <br />Mr Mihalkanin moved for adoption of the Ordinance on emergency, and Mr <br />Guerrero seconded the motion Mr Jones inquired as to the $150,000 00 <br />Mr O'Leary stated the $150,000 00 is the design He stated this <br />Ordinance puts the funding in place for the design work The Council then <br />I voted unanimously for adoption of the Ordinance on emergency <br /> <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ADDING SECTION 2 545 OF THE CITY CODE TO DESIGNATE THE MAYOR AND CITY <br />MANAGER TO PERFORM PROCEDURAL STEPS RELATED TO THE CREATION OF THE TAX <br />INCREMENT REINVESTMENT ZONES, INCLUDING PROCEDURAL PROVISIONS, AND <br />DECLARING AN EMERGENCY <br /> <br />Mr Diaz moved for adoption of the Ordinance with amendments, on emergency, <br />and Mr Guerrero seconded the motion Mr O'Leary stated State Statutes <br />provide for the governing body of a municipality to take such procedural <br />steps as providing notice of a proposed TIRZ designation to other taxing <br />units, making a presentation to governing bodies of other taxing units, and <br />meeting with representatives of other taxing units to discuss a proposed <br />TIRZ He stated in view of the logistical issues, the Attorney General's <br />Economic Development Handbook provides that these steps are to be performed <br />by the City Officials rather than by the governing body of a city He <br />stated the proposed Ordinance would authorize the Mayor and City Manager to <br />lact as the Council's representative for these procedural steps The <br />Council then voted unanimously for adoption of the Ordinance on emergency <br />
