<br />(3) Two GHe member~ shall be a-property owner~ or resIdent~ from one of the <br />San ,^ Jltomo hIstonc dIstnct~ desIgnated under SectIOn 4.2.5.1( c)(1 ) of thIs I <br />Land Development Code, other than the downtown hIstonc dIstnct. The <br />CouncIl wIll endeavor to rotate appomtments to the CommISSIOn evenly <br />from among these dIstncts. <br /> <br />(4) One member shall be a property ov;ner or resIdent from the Bel'l1n Street <br />hIStoric dIStnct. <br /> <br />(5) One member shall be a property owner, 6f busmess owner, or resIdent <br />wIthm the downtown hIstonc dIstnct. <br /> <br />(6) One member shall be a property ovmer or resIdent from the DlHlbar hIstonc <br />dIstnct. <br /> <br />(b) Term of Office The members of the Histonc PreservatIOn CommISSIOn shall <br />serve three-year staggered terms, wIth three members bemg appomted m Jarn.Iary <br />ef one year, two members appomted m January of the next year, and two <br />members bemg appomted m Jarnlary of the followmg year An appomtment to <br />fill a vacancy shall be for the unexpIred term. <br /> <br />SECTION 2. Current members ofthe Historic Preservation Commission will serve out the <br />terms of office to which they were appomted At the conclusion of those terms of office, or m the I <br />event a vacancy in a position occurs prior to the end of such a term of office, the persons <br />appointed to positions on the Commission must be appropnately qualified under the terms of thIS <br />ordmance <br /> <br />SECTION 3 If any word, phrase, clause, sentence, or paragraph OfthIS ordinance IS held <br />to be unconstitutIOnal or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will contmue in force If they can be given effect without the invalid portion. <br /> <br />SECTION 4 All ordmances and resolutIOn or parts of ordmances or resolutions m conflict <br />WIth thIS ordmance are repealed. <br /> <br />SECTION 5 Any person VIOlating any proviSIOn of this ordmance commIts a mIsdemeanor <br />and IS subj ect to the penalty prOVIded m SectIOn 1 015 of the San Marcos CIty Code upon conVIctIOn. <br /> <br />SECTION 6 ThIS Ordmance WIll take effect 10 days after the date of ItS final passage, and <br />the CIty Secretary WIll publIsh notice of ItS adoptIOn m a newspaper of general cIrCUlatIOn m the <br />CIty <br /> <br />PASSEDANDAPPROVEDonfirstreadmg November 15, 2005. <br /> <br />I <br /> <br />PASSED AND APPROVED on second readmg December 7, 2005. <br /> <br />2 <br />
