If the CIty Manager determInes that CF AN has faIled to mamtam the full number offull-tlme Jobs described In SectIOn 2 03 for a calendar year ofthe Abatement Penod, then CFAN's Tax Abatement for the followmg tax year wIll be hmIted to AIB of the Increase In the taxable value of the FacIhty, wIth "A" bemg the number of full-tlme Jobs mamtaIned dunng the prevIOUS calendar year, and "B" beIng the number of full-tlme Job eqUIvalents reqUIred to be mamtaIned for the prevIOUS calendar year Section 5.04 If thIS Agreement IS termmated by the CIty under thIS Part 5, CF AN WIll pay to the CIty the full value of all fee Waivers provIded for In SectIOn 6 01 below wIthIn 60 days of the termmatIOn date The CIty wIll be entltled to record a hen agamst the Property to secure the full value of the fees so Waived If thIS payment IS not tImely made. Section 5.05 At the tlme thIS Agreement IS fully performed by CF AN, and upon the wntten request of CF AN, the CIty Manager wIll execute a certIficate In recordable form statmg thIS Agreement has been performed, and CF AN wIll be released of all further dutIes or obhgatIOns under thIS Agreement. Section 5.06. The CIty reserves the sole dIscretIOn to choose among the remedIes for default enumerated In SectIOns 5 0 I through 5 04 accordIng to the type of default. These remedIes may be used m conJunctIOn wIth one another or separately, and together wIth any other statutory or common law remedIes aVailable to the CIty Any failure by the CIty to enforce thIS Agreement wIth respect to one or more defaults by CF AN WIll not Waive the CIty'S abIhty to enforce the agreement after that tIme PART 6. ECONOMIC INCENTIVES PROVIDED BY THE CITY Section 6.01. As partial conSIderatIOn for the constructIOn ofthe FacIhty and the creatlon of the Jobs by CF AN described m Part 2 above, the CIty agrees to prOVIde the follOWIng InCentIves and benefits to CF AN I The CIty agrees to Waive all CIty fees (the "Fee WaIver") aSSOCiated WIth zonmg, the subdIVIsIOn process, and bUIldmg permIts and mspectIOns assocIated WIth the constructIOn of the Improvements and the mstallatlon of the EqUIpment at the FacIhty The Fee Waiver does not extend to water and wastewater Impact fees 4
