I I I 1 03 Attachment means each aenal cable, messenger cable, guy WIre, anchors, and other appurtenant and mCIdental faCIlIties, and each amplIfier, repeater, applIance or other deVIce or pIece of eqUIpment affixed to a Pole to provIde or faCIlItate ElectrIC and/or CommUnICatIOns ServIce. For purposes of determmmg the number of Attachments on a Pole, all attachments of a LIcensee wIthm one vertIcal foot of space on a Licensor's Pole wIll be counted as a smgle Attachment; nsers wIll be counted as a smgle Attachment regardless of theIr length on a Pole, and connectIOns to MGNV grounds wIll not be counted as Attachments. 1 04 Communications Service means the prOVlSlon of TelecommunIcatIOns ServIce over wIre, cable or WIreless faCIlIties utilIzmg Attachments to the Poles. 1 05 Conduit System means the underground condUIt, Innerduct, manholes, vaults, nsers, pull- boxes and trenches of a Party's faCIlItIes and eqUIpment. 1 06 Day means calendar day I 07 Electrical Service means the transmISSIOn of electnc servIce through WIre or cable faCIlItIes utIlIzmg Attachments to the Poles. I 08 Includes means mcludmg, WIthout lImItatIOn. 1 09 Licensee means a Party that makes an Attachment to a Pole that IS owned or controlled by the other Party A reference to Licensee m thIS Agreement means eIther the CIty or CenturyTel when that Party IS makmg, operatmg or mamtammg an Attachment on a Pole owned or controlled by the other Party 1 10 Licensee's Facilities, as It applIes to the CIty, means all of the Attachments, and all other cables, Wires, and associated eqUIpment used by the CIty to proVIde or faCIlItate Electncal ServIce. LIcensee's FacIlIties, as It applIes to CenturyTel, means all of the Attachments, and all other cables, WIres, and associated eqUIpment used by CenturyTel to proVIde or faCIlItate CommunIcatIOns ServIce. I 11 Licensor means a Party that owns or controls a Pole to whIch the other Party or an Other LIcensee makes an Attachment. A reference to Licensor m this Agreement means eIther the CIty or CenturyTel when that Party owns or controls a Pole to WhICh the other Party IS makmg, operatmg or mamtammg an Attachment. I 12 Licensor 's Facilities, as It applIes to the CIty, means the Poles and associated Electncal SerVIce facIlIties and eqUIpment owned or controlled by the CIty Licensor's Facilities, as It applIes to CenturyTel, means the Poles and associated CommunIcatIOns ServIce faCIlItIes and eqUIpment owned or controlled by CenturyTel 2
