MUTUAL GRANT OF LICENSES 201 Each Party, as LIcensor, grants to the other Party, as LIcensee, a revocable, nonexclusIve lIcense authonzmg the LIcensee to mamtam ItS eXIstmg Attachments on the LIcensor's Poles, and to mstall and mamtam new Attachments on the LIcensor's Poles, subJect to the provlSlons of thIS Agreement. 2 02. Each Party, as LIcensee, agrees to be bound by all prOVlSlons of thIS Agreement and of the PermIts Issued under thIS Agreement WIth respect to that Party's Attachments to the Poles of the other Party, as LIcensor 2.03 Each Party, as LIcensor, agrees to Issue Permits to the other Party, as Licensee, for new attachments to the LIcensor's Poles only when the LIcensor determmes, m ItS sole Judgment, that 1) the LIcensor has suffiCIent capaCIty on the Poles to accommodate the proposed Attachments, 2) the LIcensee meets all reqUIrements set forth m thIS Agreement, and 3) the PermIt complIes With all of the ApplIcable Standards. The partIes further agree that the use of the Poles by a Party as LIcensee IS subJect to the nght of the other Party, as LIcensor, to reclaIm Reserved Space m accordance WIth thIS Agreement. 204 No Issuance of any PermIt by a Party, as LIcensor, to the other Party, as LIcensee, and no use by the LIcensee of any of the LIcensor's FaCIlItIes, regardless of nature or duratIOn, and no payment of any fees or charges reqUIred under thIS Agreement, wIll create or vest m the LIcensee any easements or other ownershIp or property nghts of any nature m any of the LIcensor's FacIlIties. ThIS Agreement, and any PermIt granted under thIS Agreement, wIll not constItute an aSSIgnment of any of a LIcensor's nghts to the LIcensor's FacIlIties. 2 05 ThIS Agreement does not grant any nght to eIther Party, as LIcensee, to place Attachments on any speCIfic Pole of the other Party, as LIcensor, or to compel the other Party, as Licensor, to grant the LIcensee a PermIt to place Attachments on any speCIfic Pole of the LIcensor 2.06 A LIcensee wIll obtam all necessary certIficatIOns, permIts, and franchIses from Federal, state and local authontIes pnor to makmg any Attachments. 207 ThIS Agreement does not m any way lImIt a LIcensor's nght to locate, operate and mamtam the LIcensor's Poles m the manner the LIcensor belIeves wIll best enable It to fulfill ItS own serVIce reqUIrements. 2 08 ThIS Agreement does not reqUIre a LIcensor to mstall or retam any LIcensor's Pole for use by a LIcensee when the LIcensor determmes that the Pole IS not needed for the Licensor's own servIce reqUIrements. 4
