I I I pnor to the CIty'S final approval of constructIOn contract documents, the Engmeer wIll mOllltor the establIshed probable constructIOn cost m relatIOn to the establIshed fixed lImIt. 3.2 4 In provIdmg opmIOns of cost, finanCIal analyses, economIC feasibIlIty proJectIons, and schedules for the ProJect, the Engmeer has no control over cost or pnce of labor and matenals, unknown or latent condItIons of eXIstmg eqUIpment or structures that may affect operatIon or mamtenance costs, competItIve bIddmg procedures and market condItIons, tIme or qualIty of performance by thIrd partIes, qualIty, type, management, or dIrectIon of operatmg personnel, and other economIC and operatIonal factors that may matenally affect the ultImate ProJect cost or schedule. Therefore, the Engmeer makes no warranty that the CIty'S actual ProJect costs, finanCIal aspects, economIC feasibIlIty, or schedules wIll not vary from the Engmeer's opmIOns, analyses, prOJectIOns, or estImates. If necessary, the Engmeer wIll Implement constructIon cost savmgs measures or otherwIse endeavor to lImIt probable constructIOn cost to the level of aVailable funds set by the CIty ARTICLE 4 REIMBURSABLE EXPENSES. 4 1 ReImbursable expenses, mcludmg such thmgs as expenses for plottmg, reproductIOn of documents, auto travel mIleage, delIvery charges, long dIstance commulllcatIOns, and freIght are mcluded m the Engmeer's baSIC servIces compensatIon. A multIplIer of 1 15 WIll be applIed to all dIrect expenses. ARTICLE 5 PAYMENTS TO THE ENGINEER 5.1 PAYMENTS ON ACCOUNT OF BASIC SERVICES AND SPECIAL SERVICES Payments for BaSIC SerVIces and for SpeCial ServIces WIll be made to Engmeer monthly followmg receIpt by City of Engmeer's mVOIces and appropnate payment requlSltIOns. The amounts of these mVOIces WIll be based upon the extent of work completed by the Engmeer on a percentage baSIS wIthm each phase of servIces, m accordance WIth ArtIcle 14 of thIS Agreement, less any dIsputed amounts, pendmg resolutIOn thereof. 5.2 PAYMENTS ON ACCOUNT OF ADDITIONAL SERVICES Payments on account of the Engmeer's AddItIOnal ServIces as defined m SectIOn 1 7 WIll be made monthly upon presentatIOn of the Engmeer's statement of servIces rendered or expenses mcurred, less any dIsputed amounts, pendmg resolutIOn thereof and an AuthonzatIOn of Change m ServIces form executed by the Engmeer and the City ARTICLE 6 ENGINEER'S RECORDS 6.1 All expense records of Engmeer WIll be kept on a recognIzed accountmg baSIS acceptable APAI Surface Water Expansion 12
