<br />of Work without written authorization from the City. Any such deviation will be <br />included in an amendment to this Agreement. <br /> <br />1.4 All work specified in the Statement of Work will be satisfactorily completed <br />within 60 days from the effective date of this Agreement. <br /> <br />ARTICLE 2 <br />SUBRECIPIENT'S RESPONSIBILITIES <br /> <br />Subrecipient certifies that: <br /> <br />2.1 Subrecipient will utilize the grant funds it receives under this Agreement to perform <br />the services identified in the Statement of Work in compliance with all the terms and <br />conditions specified in this Agreement. <br /> <br />2.2 Subrecipient has qualified for grant funding under the Low to Moderate Income <br />guidelines as set forth in Section 8 Income Limits established and amended annually by <br />HUD (Exhibit"D"). <br /> <br />2.3 Subrecipient has resided in and been the owner(s) of the residence to be <br />rehabilitated for at least six months prior to the submission of its application. <br /> <br />2.4 The residence to be rehabilitated is a permanent, non-mobile housing unit and it <br />cannot be made mobile by the addition of any apparatus used to transport mobile homes. <br /> <br />2.5 The residence to be rehabilitated is not located in a flood zone area as defined in <br />the City of San Marcos Flood Insurance Map, produced by the Federal Emergency <br />Management Agency, or if it is located in a flood zone, the Subrecipient has sufficient flood <br />insurance. <br /> <br />2.6 The residence is structurally sound and the completion of the rehabilitation will result <br />in significant improvements to the residence. <br /> <br />2.7 All property taxes on the property are paid up to date, including City, County and <br />applicable School District Taxes. <br /> <br />2.8 The residence is not under a Contract for Deed, or any similar purchase <br />agreement, in which the Subrecipient does not obtain legal title until final payment is made. <br /> <br />2.9 Sub recipient has not received HUD Program assistance for the preceding five <br />years. <br />2.10 Subrecipient will ensure that all work performed under this Agreement is permitted <br />and inspected by the City's Department of Planning and Development Services Building <br /> <br />2 <br />
