<br />63. <br /> <br />AMENDMENT NUMBER ONE TO LEASE OF AIRPORT <br />PROPERTY/BUILDINGS BETWEEN <br />HEARN AVIATION, INC. AND THE CITY OF SAN MARCOS, TEXAS <br /> <br />STATE OF TEXAS ~ <br />~ <br />COUNTY OF HAYS AND CALDWELL ~ <br /> <br />The City of San Marcos, Texas, a municipal corporation organized and existing under the <br />laws of the State of Texas ("Lessor") and Hearn Aviation Inc. ("Lessee"), agree to amend their <br />lease agreement entered into on August 1, 199B. <br /> <br />1. Lessor and Lessee agree to an amendment of Paragraph 10.1 of the Lease, as amended, <br />to read as follows: <br /> <br />10.01. The Lessee may sublease space in the Building for private as well as <br />commercial storage of aircraft or other aviation business, with the consent of the <br />Lessor, and as long as the terms of the Lessor's standard T -Hangar and/or <br />Sublease of Airport Property for Operation of Business leases are used for each <br />sublease. Consent by Lessor to one or more assignments or sublettings shall not <br />operate as waiver of Lessor's rights as to any subsequent assignments and <br />sublettings. Notwithstanding any assignment or subletting, Lessee shall at all times <br />remain fUlly responsible and liable for the payment of the rent specified and for <br />compliance with all of its other obligations under this Lease. <br /> <br />In all other respects, except as modified, the terms and provisions of the original lease, <br />as amended, shall remain in full force and effect.
