<br />&\1:ERICAN NATIONAL INSURANCE COMPANY <br />One Moody Plaza. Galveston, Texas 77550 <br /> <br />ORGAN TRANSPLANT COVERAGE AMENDMENT <br /> <br />Attached to and made a part of the Excess Loss Reinsurance Treaty between San Marcos. City Of (hereinafter <br /> <br />"Company") and American National Insurance Company (hereinafter "Reinsurer") <br /> <br />Effective August 1. 2000. Treaty Number: SLOO 1. <br /> <br />In consideration of the mutual covenants herein contained and intending to be legally bound hereby, the parties <br />agree that the referenced Treaty will hereby be amended as follows: <br /> <br />Subject to the provisions, conditions, exceptions, reductions and limitations of this Treaty, the Reinsurer agrees to <br />reimburse the Company in excess of the Specific Retention Amount for 100% of Eligible Expenses resulting from <br />or directly related to the completion of a heart, lung, heart-lung, liver or pancreas human organ transplant <br />procedure. While this Amendment is in effect, this amendment provides coverage only for Eligible Expenses <br />incurred in 24 months and paid in 12 months. <br /> <br />Expenses of a live organ donor shall not be considered as Eligible Expenses of the organ recipient, unless the <br />donor is without coverage that provides benefits for these expenses, in which case a maximum of $5.000.00 shall <br />be considered as Eligible Expenses of the recipient. <br /> <br />All benefits provided as stated in this Amendment are limited to a lifetime maximum of $1,000,000.00 per <br />Covered Person. <br /> <br />If a Covered Person is not Actively At Work or if the Covered Person is a dependent who is hospital confmed or <br />Totally Disabled on the Effective Date of this Amendment, no coverage shall be provided under this Amendment <br />until he or she is no longer Totally Disabled. <br /> <br />"Treaty Year" means the period from the Inception Date to the Expiration Date as shown in the Company's <br />Application. <br /> <br />"Totally Disabled" means that the Covered Person is hospital confmed or is unable to perform the normal <br />functions and activities of a person of like sex and age in good health. <br /> <br />While this Amendment is in effect the coverage provided herein shall apply to all current and new Covered Units. <br /> <br />Except as expressly stated, nothing herein shall alter or affect any provision of the Treaty, including any prior <br />amendments, endorsements or riders. <br /> <br />This Amendment has been signed as shown below on behalf of the Reinsurer. <br /> <br />AMERICAN NATIONAL INSURANCE COMPANY <br /> <br />v;1 ~\ ~ <br /> <br />Secretary <br /> <br />ELT-I OTA (rev. 9/98) <br />
