<br />AMERICAN NATIONAL INSURANCE COMPANY <br />One Moody Plaza. Galveston, Texas 77550 <br /> <br />SPECIFIC EXCESS BENEFIT ADVANCE AGREEMENT <br /> <br />Attached to and made a part of the Excess Loss Reinsurance Treaty between San Marcos. City Of (hereinafter <br />"Company") and American National Insurance Company (hereinafter "Reinsurer") <br />Effective AUlnlSt I. 2000. Treaty Number: SLOO I. <br /> <br />In consideration of the mutual covenants herein contained and intending to be legally bound hereby, the parties <br />agree as follows: <br /> <br />ARTICLE I - OPERATION <br /> <br />(I) SPECIFIC EXCESS BENEFIT ADVANCEMENT PROVISION. Subject to the terms and conditions of your <br />Excess Loss Reinsurance Treaty with the Reinsurer, the Reinsurer will advance reimbursement of your <br />Specific Excess Benefit in excess of your deductible plus $5.000.00 according to the terms of the contract then <br />in effect for an eligible claim. <br /> <br />(2) YOU and YOUR Administrator must sign and complete a F.A.S.T. Request Form for each individual's claim <br />submitted for advancement. <br /> <br />(3) FEE FOR AGREEMENT. The Company agrees to pay a (one-time) set up fee of ($N/A) plus ($N/A) per <br />employee per month claims fee during any period that this Agreement is in effect. This fee is due and payable <br />the fIrst day of each Treaty Month. <br /> <br />(4) FEE PAYMENT. The Company shall pay the fees according to the terms of the Treaty. The Reinsurer shall <br />not be obligated to advance any reimbursement under this Agreement if the Company is not current on <br />premium payments. <br /> <br />ARTICLE n - TERMINATION <br /> <br />(1) This Agreement shall be in effect for as long as the Company remains covered under the Treaty, provided that <br />during the term of this Agreement the Company continues to pay any required premiums and fees due pursuant <br />to the terms of the Treaty. In event premiums or fees are not paid and coverage lapses, this Agreement shall <br />terminate immediately. <br /> <br />(2) If coverage is canceled, lapsed or terminated for any reason, this Agreement shall terminate. <br /> <br />ARTICLE ill - GENERAL PROVISIONS <br /> <br />(1) OTHER CONTRACTS. This Agreement supersedes any and all other contracts, either oral or in writing, <br />between the parties hereto to the extent the provisions of this Agreement are inconsistent with such other <br />contracts. <br /> <br />(2) NON-WAIVER. The failure of either party to this Agreement to exercise any right or privilege herein <br />contained, even if known, shall not be deemed a waiver of any such right or privilege or a waiver of any rights <br />or remedies hereunder, present or future. <br /> <br />(3) SEVERABILITY. If any term or provision of this Agreement is held by a court to be illegal or in conflict <br />with federal or state law, the validity of the remaining terms and provisions hereof shall not be affected. <br />
