(a) Purpose. The purpose of a development agreement is to enable <br />development of land in the City's extraterritorial jurisdiction to occur at densities or <br />intensities of use that require public water and wastewater services and that are to be <br />governed by standards applicable to development inside the City limits. The purpose of <br />the agreement also shall be to provide for development outside the City limits that is <br />compatible with development inside the City limits in anticipation of eventual annexation <br />of the land subject to the agreement into the City. <br />(b) Applicability. A development agreement shall be used where either of the <br />following is applicable: <br />(1) Iii is likely that the property subject to the agreement will remain in the <br />extraterritorial jurisdiction for a period exceeding five years and the property owner seeks <br />to pursue development prior at urban level residential densities or intensities of use. <br />(2) The Citv proposes to annex a Dropertv within the ETJ that is appraised for <br />ad valorem tax purposes as land for agricultural, wildlife management, or <br />timber use. A development agreement, consistent with the provisions of <br />the Local Government Code, shall be established. <br />SECTION 10. Chapter 4, Zoning Regulations, Article 2, Zoning Districts, Division 1, <br />Residential Districts, Section 4.2.1.11, MF -12, Multiple - Family Residential District, is amended <br />to read as follows: <br />Section 4.2.1.11 MF -12, Multiple- Family Residential District <br />(a) Purpose. The MF -12 Multiple - Family Residential District is intended for <br />development of multiple - family, apartment residences at not more than 12 units per acre. <br />This district should be located adjacent to a major thoroughfare and may serve as a buffer <br />between low or medium density residential development and nonresidential development <br />or high - traffic roadways. <br />(b) Authorized Uses. Permitted and conditional uses, as authorized in the Land <br />Use Matrix in Article 3, Division 1 of this Chapter 4. Accessory uses as authorized in <br />Article 3, Division 2 of this Chapter 4. <br />(c) Additional Development Standards. See Table 4.1.6.1. <br />(d) Additional Area, Building and Height Requirements: <br />(1) Minimum Lot Area: <br />a. 3,630 square feet per dwelling unit for the first three dwelling <br />units, plus as much additional lot area as necessary for each <br />dwelling unit over three so that the total gross density does not <br />
