The City Planning and Zoning Commission conducted a public hearing on May 23, 2000 <br />on a proposed amendment to Section 114.001 of the Zoning Chapter of the City Code to clarify the <br />defInition of "church", and on proposed amendments to Sections 114.471 and 114.472 of the Zoning <br />Chapter of the City Code to make churches specific uses rather than permitted uses in "LB" Limited <br />Business districts. <br /> <br />2. The Planning and Zoning Commission voted on May 23, 2000 to recommend the <br />proposed changes for adoption by the City Council. <br /> <br />3. The City Council conducted a public hearing on the proposed changes on <br />Julv 10 ,2000. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The definition of "church" in Section 114.001 of the City Code is amended as <br />follows: <br /> <br />Church means a building or structure or ~ grouI'@ of buildings or structures which by design~ <br />aH:El construction or use is are primarily intended for the conducting of organized religious <br />services and associated accessory uses~ associated there'Nith and which is recognized as a <br />church by the Internal Revenue Service. <br /> <br />SECTION 2. Sections 114.471 and 114.472 of the Zoning Chapter of the City Code are <br />amended as follows (underlining indicates added text; overstrike indicates deleted text): <br /> <br />Sec. 114.471. Permitted uses. <br /> <br />The uses permitted in the LB limited business district are as follows: <br /> <br />(1) Business, administrative, professional, and social service offices. <br /> <br />(2) Medical, dental and optical offices, clinics, and laboratories; counseling <br />servIces. <br /> <br />(3) Fraternal buildings. <br /> <br />(4) Bed and breakfast inns. <br /> <br />(5) Business, trade, or fine arts schools where all activities and facilities are <br />entirely within a totally enclosed building. <br /> <br />(6) The following uses, provided that there is no outdoor storage, no vehicle <br />fuel or service facilities, no vehicle drive-up or drive-through facilities, <br />and no on-premises consumption of alcoholic beverages; and provided that <br />the size or capacity is limited so that no more than 15 off-street parking <br />spaces would be required according to the standards contained in section <br />
