<br />WHEREAS, this agreement certifies that it is understood by all of the participating entities that it <br />is the responsibility of the members of the collaborative to determine how to resolve grievances, <br />and subcontract with other organizations and individuals as needed. <br /> <br />NOW THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: <br /> <br />ARTICLE I. PURPOSE <br />The purpose of this Agreement is to allow San Marcos Consolidated Independent School <br />District, Southwest Texas State University, the City of San Marcos, The City of San Marcos <br />Public Library, Central Texas Medical Center, Community Action Inc., City of Martindale, City <br />of San Marcos Housing Authority, San Marcos Youth Services Bureau, Willie Mae Mitchell <br />Youth Opportunity Center, San Marcos Area Chamber of Commerce, Redwood Mission Baptist <br />Church, and St. John's Church Even Start Program to file an application for a community <br />networking grant with the TIF Board. <br /> <br />ARTICLE II. TERM <br />The term of this Agreement shall commence upon the execution of this Agreement and end <br />September 1, 2002. <br /> <br />ARTICLE III. CONSIDERATION <br />As consideration for this agreement, members of the San Marcos CommunityNet agree to <br />contribute a total of $49,800.00 in local funds for the enhancement of the project in the amounts <br />as follows: <br /> <br />San Marcos CISD - $45,936 <br />City of San Marcos - S 3,864 <br />The governmental entities that are parties to this agreement acknowledge that their payments <br />under this agreement will be made from current revenues available to each of them, and that the <br />City's payment under this agreement is an amount that is fair. <br /> <br />ARTICLE IV. ALLOCATION OF RESOURCES <br />4.01 The specific allocation of the TIF Board funds is to San Marcos Consolidated Independent <br />School District, which will then place equipment as described in the work plan in the application <br />among the members of San Marcos CommunityNet. By signing this Agreement, an the <br />participating entities certify that each member will be held responsible for assuring that the <br />equipment and project are managed according to TIF Board guidelines. <br /> <br />4.02 San Marcos CISD will retain ownership of , equipment purchased with the grant, and all <br />entities hosting public access sites agree that a) the equipment will be secured, insured, and <br />monitored with diligence; b) a staff person designated as a "public access coordinator" will see <br />that the equipment is maintained and that appropriate requests for warranty service be requested <br />as needed; c) any missing parts will be replaced; d) the coordinator will attend two hours of <br /> <br />Interlocal Agreement for San Marcos CommunityNet <br /> <br />Page 2 of 5 <br />
