<br />38. <br /> <br />RESOLUTION 2000-18lR <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS URGING THE TEXAS <br />MUNICIPAL LEAGUE TO SUPPORT LEGISLATION TO <br />STRENGTHEN COUNTY SUBDIVISION DEVELOPMENT <br />AUTHORITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Substantial suburban growth is occurring in many rural areas of Texas, outside of areas of <br />municipal subdivision and zoning controls. <br /> <br />2. Much of this growth is taking place in areas that are limited in overall water supply, or <br />sensitive with respect to groundwater resources or other environmental issues. <br /> <br />3. Texas counties need additional subdivision control authority to effectively manage this <br />growth. <br /> <br />4. Texas cities should support additional county subdivision control authority in the interest of <br />ensuring high quality, sustainable growth in areas that may one day become a part of their <br />jurisdiction. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. <br />TEXAS: <br /> <br />PART 1. The City Council urges the Texas Municipal League to support the enactment of the <br />following measures by the Texas Legislature to strengthen county subdivision platting authority: <br /> <br />A. Authority for counties adjacent to counties with a population greater than 500,000 to <br />adopt minimum standards for impervious cover, stormwater retention, and pollution <br />elimination. <br /> <br />B. Authority for counties adjacent to counties with a population greater than 500,000 to <br />implement zoning controls. <br /> <br />C. Authority for counties to charge impact fees or to require boundary street <br />improvements when new subdivisions are developed on existing substandard county <br />roads. <br /> <br />D. Authority for counties to establish notification requirements for property owners <br />within a specified distance of an existing lot proposed for resubdivision, and to require <br />notices to also be posted on site. <br /> <br />E. Authority for counties to deny utility connections to areas that are improperly <br />subdivided. <br /> <br />F. Authority for all counties to establish planning commissions. <br /> <br />PART 2.
