City of San Marcos <br /> <br />Dear Mr. Taylor: <br /> <br />Thank you for considering our firm's qualifications to represent the City in the above styled <br />litigation. Please permit this letter to serve as our engagement letter and fee agreement. <br /> <br />We are pleased to represent the City of San Marcos in this matter on an hourly fee basis. Our <br />fee structure is as follows: <br /> <br />Terry D. Morgan: <br />G. Walter McCool <br />Gary S. Spencer <br />Associates <br />Legal Assistants <br /> <br />$225 per hour. <br />$200 per hour. <br />$185 per hour. <br />$125 - $150 per hour <br />$65 per hour. <br /> <br />We will send monthly invoices to you at the above address, and our invoices are due on <br />receipt. We charge for expenses as follows: for in-office photocopying, $0.25 per page; for <br />telecopying, $1.00 for the first page of a transmission, and $0.25 per subsequent page; for postage, <br />cost. We will bill the City of San Marcos at cost for out-of-pocket expenses, but will not incur any <br />unusual expense without your prior approval. <br /> <br />Although we are located in Dallas, we do not bill for travel time or expenses. It is our goal <br />that, in retaining our firm, the City will incur no additional expense above what it would pay to local <br />counsel. <br /> <br />In the course of representing the City of San Marcos in this matter, the firm will provide the <br />following services: <br />
