Upon completion of our review of the City's files and other pertinent information, <br />we will provide you a written evaluation of the viability of the plaintiffs' claims, and <br />of the City's defenses and counterclaims. <br /> <br />2. Mr. Morgan and Mr. McCool will attend an initial meeting with key City <br />representatives to discuss the litigation. <br /> <br />3 . We will provide you copies of significant documents that we generate or receive in <br />the course of this representation (other than from the City), such as pleadings, <br />settlement proposals, significant discovery documents, and research memoranda. <br /> <br />4. We will provide you periodic written reports regarding all significant developments <br />in this matter. <br /> <br />5 . We will coordinate closely with your office regarding ongoing developments and <br />strategies relating to the case. <br /> <br />6. We will be available to attend meetings with City officials, and to attend hearings in <br />San Marcos regarding the case. <br /> <br />7. We will provide detailed billing statements reflecting tasks performed, personnel <br />involved, and time expended. <br /> <br />If these terms are not acceptable to you, please call me as soon as possible to discuss your <br />questions or concerns regarding our engagement. Otherwise, please submit this letter agreement to <br />the City Manager for his review and approval and return the enclosed signed copy to me. <br /> <br />I am pleased to welcome you as our firm's client, and am grateful for the trust you have <br />placed in us. While I am sure you will be pleased with our service, please notify me promptly if at <br />any point you feel we are not meeting your expectations. <br /> <br />Thank you again for this opportunity to represent the City of San Marcos.
