<br />ARTICLE 4 <br />THE SMCISD'S RESPONSIBILITIES <br /> <br />The SMCISD will: <br /> <br />4.1 Thirty days prior to each auction, provide the Auctioneer with a preliminary list of <br />items to be sold prior to the commencement of advertising by the Auctioneer. A more <br />detailed listing of items will be provided by the SMCISD at least two days prior to the <br />auction. The SMCISD reserves the right to add or delete items for sale for any reason until <br />the time of the actual sale. <br /> <br />4.2 Be responsible for transporting all movable SMCISD property to the auction site <br />beginning one to two days prior to the date of each auction. Non-movable items will be <br />available for inspection prior to the Auction. SMCISD will transport any unsold SMCISD <br />property from the auction site before the end of the day on which each auction takes place. <br /> <br />4.3 Perform all necessary paperwork for the SMCISD to transfer vehicle and equipment <br />titles and provide a bill of sale for vehicles and equipment that do not have titles. <br /> <br />4.4 Collect SMCISD's sales receipts at the auction site. <br /> <br />4.5 Designate the SMCISD Purchasing Manager as the SMCISD's representative. The <br />SMCISD representative will be present at the auction site at all times during the auction. <br /> <br />4.6 Acknowledge its total proceeds to the Auctioneer at the end of the day of the <br />Auction. <br /> <br />ARTICLE 5 <br />PAYMENTS TO THE AUCTIONEER <br /> <br />5.1 The Auctioneer will deduct the payment for its services prior to sending a separate <br />check to the City for its proceeds from the Auction and to the County for its proceeds from <br />the Auction. The amounts of these payments will be in accordance with Section 12.1 of <br />this Agreement, less any disputed amounts, pending resolution thereof. <br /> <br />ARTICLE 6 <br />AUCTIONEER'S RECORDS <br /> <br />6.1 All expense records of Auctioneer will be kept on a recognized accounting basis <br />acceptable to both the City and County and will be available to the City, the County or the <br />SMCISD and/or the authorized representative of the City, County or the SMCISD at <br />mutually convenient times. <br /> <br />6.2 The Auctioneer will furnish to the City, the County or the SMCISD at such time and <br /> <br />8 <br />
