ORDINANCE NO. 2011- 6 0 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, CONCERNING A 10.735 ACRE, MORE OR LESS, <br />TRACT OF LAND LOCATED AT 1311 NORTH IH -35; APPROVING AN <br />AMENDMENT TO THE FUTURE LAND USE MAP OF THE CITY <br />FROM "C" COMMERCIAL TO "HDR" HIGH DENSITY RESIDENTIAL <br />FOR A 2.547 ACRE, MORE OR LESS, PORTION OF SAID TRACT; <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING 8.188 ACRES OF SAID TRACT FROM "MF -24" MULTIPLE - <br />FAMILY RESIDENTIAL DISTRICT AND 2.547 ACRES OF SAID TRACT <br />FROM "GC" GENERAL COMMERCIAL DISTRICT EACH TO "PDD" <br />PLANNED DEVELOPMENT DISTRICT WITH BASE ZONING OF "MF- <br />24" MULTIPLE - FAMILY RESIDENTIAL DISTRICT; APPROVING <br />PLANNED DEVELOPMENT DISTRICT STANDARDS FOR THE <br />LUXURY APARTMENT COMMUNITY AT THORPE PLANNED <br />DEVELOPMENT DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br />RECITALS: <br />1. On October 25, 2011 and November 8, 2011, the City Planning and Zoning <br />Commission of the City of San Marcos held public hearings concerning a 10.735 acre, more or <br />less tract of land located at 1311 North lH -35 as further described in Exhibit "A ", attached hereto <br />(the "Project Site ") as follows: <br />a) regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "C" Commercial to "HDR" High Density Residential <br />for a 2.547 acre portion of said tract (Tract A); <br />b) a request to change the zoning for Tract A from "GC" General <br />Commercial District to "PDD" Planned Development District with base zoning of "MF- <br />24" Multiple- Family Residential District; and <br />C) a request to change the zoning for 8.188 acres of said tract (Tract B) from <br />"MF -24" Multiple - Family Residential District to "PDD" Planned Development District <br />with base zoning of "MF -24" Multiple- Family Residential District. <br />2. Subsequent to the public hearings on such dates, the Planning and Zoning <br />Commission, on November 8, 2011 considered and voted to approve the requests, and has <br />recommended that the requests be approved by the City Council of the City of San Marcos. <br />3. The City Council held a public hearing on November 15, 2011 regarding the <br />requests. <br />
