4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan <br />is revised to change the future land use designation for Tract A, described below, from "C" <br />Commercial to "HDR" High Density Residential: <br />Street address: 1311 North IH -35 <br />Size: 2.547 acres, more or less <br />Legal description: A 2.547 acre tract situated in the J.M Veramendi League Number 2, <br />Hays County, Texas as further described by metes and bounds in Exhibit "B ", attached <br />hereto, and made a part hereof for all purposes. <br />SECTION 2. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone Tract A from "GC" General Commercial <br />District to "PDD" Planned Development District with base zoning of "MF -24" Multiple- Family <br />Residential District. <br />SECTION 3. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone Tract B, described below, from "MF -24" <br />Multiple - Family Residential District to "PDD" Planned Development District with base zoning <br />of "MF -24" Multiple- Family Residential District: <br />Street address: 1311 North IH -35 <br />Size: 8.188 acres, more or less <br />Legal description: A 10.735 acre tract situated in the J.M Veramendi League Number 2, <br />Hays County, Texas as further described by metes and bounds in Exhibit "A ", attached <br />hereto and made a part hereof for all purposes, save and except 2.547 acres comprising <br />Tract A. <br />SECTION 4. The Planned Development District Standards for the Luxury Apartment <br />Community at Thorpe Planned Development District, attached to this ordinance as Exhibit "C" <br />(the "Regulations "), are approved and adopted to regulate the development of the Project Site. <br />The Project Site will be bound by the provisions of the Regulations as though they were <br />conditions, restrictions and limitations on the use of the Project Site under the City's zoning <br />
