1. Introduction <br />This proposed 13.0 acre re-zoning tract is located at the northeast comer of Riverway Avenue <br />and Cotter Avenue, within the existing Blanco Riverwalk Subdivision. See Figure 1 for the <br />Property Location Map. The final plat for this subdivision was recorded in June 2008 in Book <br />14, Pages 311-317 of the Plat Records of Hays County, Texas. Currently, the existing zoning <br />and land use designation is Mixed Use. The proposed re-zoning is MF-24:Multi-Family <br />Residential District. The corresponding proposed future land use map amendment is High <br />Density Residential. In order to accomplish certain development goals of the Owner, an overlay <br />planned development district (PDD) is proposed. <br />As described in Section 4.2.6.1 of the Land Development Code (LDC), Planned Development <br />Districts (PDDs) are intended to encourage flexible and creative planning and to ensure the <br />compatibility of land uses. PDDs also allow for the adjustment of changing demands to meet the <br />current needs of the community and to result in a higher quality development for the community <br />than would result for the use of conventional zoning districts. Section 4.2.6.1 also provides for <br />the applicability of a PDD. For this development, the proposed PDD is established for the <br />following circumstances: <br />(2) The land, or adjacent property that would be impacted by the development of the <br />land, has sensitive or unique environmental features requiring a more flexible <br />approach to zoning, or special design standards, in order to afford the best <br />possible protection of the unique qualities of the site or the adjacent property; and <br />(7) The land is of such a character that it is in the community's best interest to <br />encourage high quality development through flexible development standards to <br />further the goals and objectives of the City's Master Plan. <br />After re-zoning and re-platting, the project will be constructed in one (1) phase, including all <br />buildings, drives and parking, utilities, landscaping and perimeter street sidewalk improvements. <br />If. Existing Project Conditions <br />This 13.0 acre tract currently is undeveloped. Refer to Figure 2. All subdivision-related <br />infrastructure improvements, including all paving, ribbon curb, drainage and utilities, were <br />completed and accepted by the City in 2008. <br />111. Subdivision Restrictive Covenants <br />The Supplemental Declaration of Restrictive Covenants of Blanco Riverwalk Subdivision was <br />recorded on June 27, 2008 in Volume 3419, Pages 425-451 of the flays County, Texas Public <br />Records. These restrictive covenants, recorded concurrently with the final plat, provide certain <br />development standards for the subdivision. This PDD hereby adopts and enforces those <br />development standards, as applicable to this 13.0 acre tract. See later discussion for Subdivision <br />Construction and Maintenance Standards. <br />3 <br />
