ORDINANCE NO. 2011- 64 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY BY REZONING A 2.42 ACRE, MORE OR LESS, TRACT OF LAND <br />LOCATED AT 120 WARDEN LANE FROM "MU" MIXED USE <br />DISTRICT TO `PDD" PLANNED DEVELOPMENT DISTRICT WITH <br />BASE ZONING OF `AMU" MIXED USE DISTRICT; APPROVING <br />PLANNED DEVELOPMENT DISTRICT STANDARDS FOR THE <br />THORPE LANE LOFTS PLANNED DEVELOPMENT DISTRICT; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />RECITALS: <br />1. On September 27, 2011, the City Planning and Zoning Commission of the City of <br />San Marcos held a public hearing regarding a request to change the zoning from "MU" Mixed <br />Use District to "PDD" Planned Development District with base zoning of "MU" Mixed Use <br />District for a 2.42 acre, more or less, tract of land located at 120 Warden Lane (the "Project <br />Site "). <br />2. Subsequent to the public hearing on such date, the Planning and Zoning <br />Commission, on October 11, 2011 considered and voted to approve the request, and has <br />recommended that the request be approved by the City Council of the City of San Marcos, <br />3. The City Council held a public hearing on November 15, 2011 regarding the <br />request. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone the following tract of real property, being <br />the Project Site, from "MU" Mixed Use District to "PDD" Planned Development District with <br />base zoning of "MU" Mixed Use District: <br />Street address; 120 Warden Lane <br />Size; 2.42 acres, more or less <br />
