Legal description: Being 2.42 acres of land, more or less, out of the J.M. Veramendi <br />League Survey, No. 2, San Marcos, Hays County, Texas and being all of Lots 1 through <br />4 and a portion of Lot 5 of W.O. Meiners Second Suburban Addition as recorded in <br />Volume 89, Page 512 of the Deed Records of Hays County, Texas, as more fully <br />described in Exhibit "A ", attached hereto and made a part hereof for all purposes. <br />SECTION 2. The Planned Development District Standards for the Thorpe Lane Lofts <br />Planned Development District, attached to this ordinance as Exhibit "B" (the "Regulations "), are <br />approved and adopted to regulate the development of the Project Site. The Project Site will be <br />bound by the provisions of the Regulations as though they were conditions, restrictions and <br />limitations on the use of the Project Site under the City's zoning ordinances. Any person, firm, <br />corporation or other entity violating any provisions of the Regulations shall be subject to all <br />penalties that apply to violations of the zoning ordinances of the City of San Marcos, as <br />amended. Any person, firm, corporation or other entity violating any provisions of the <br />Regulations shall be subject to a suit by the City for an injunction to enjoin the violation as <br />though the Regulations were conditions, restrictions and limitations on the use of the Project Site <br />under the City's zoning ordinances. <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City <br />Code upon conviction. <br />SECTION 4. After its original passage, this ordinance will be subject to reconsideration <br />at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is <br />reconsidered and approved, it shall become effective thereafter. <br />PASSED, APPROVED AND ADOPTED on November 15, 2011, subject to <br />reconsideration at the next regularly scheduled City Council meeting on December 6, 2011. <br />Reconsidered: yes / no k1 <br />If yes: approved <br />denied <br />Date: <br />niel Guerrero <br />Mayor <br />
