The LIcensee, at Its expense, shall obtain the msurance described m ExhibIt B-1, hereto <br />attached. The LIcensee will also prOVIde to the Licensor a Certificate of Insurance, identifying Folder <br />No. 02364-22, Issued by Its msurance carrier confirmmg the existence of such insurance and that the <br />pohcy or poliCIes contain the followmg endorsement: <br /> <br />UNION PACIFIC RAILROAD COMPANY IS named as an additIOnal msured with respect <br />to allliabihties arising out of the eXIstence, use or any work performed on or assocIated <br />wIth the 'PIpelme' located on Railroad nght-of-way at Mile Post 208.8, on the Austin SubdiviSIOn, <br />at or near San Marcos, Hays County, Texas. <br /> <br />B. If the LIcensee named m thIS Agreement IS a pubhc entIty subJect to any apphcable statutory <br />tort laws, the hmIts of Insurance described m ExhibIt B-1 shall be the limIts the LIcensee then has in <br />effect or whIch IS reqUIred by apphcable current or subsequent law, whIchever IS greater, a portion of <br />WhICh may be self-msured wIth the consent and approval ofthe Licensor <br /> <br />C.
