67. <br />Regular Meeting February 7, 2006 Page 10 <br />Mayor Narvaiz introduced for consideration Item 27, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AGREEMENT BETWEEN THE CITY AND FUGRO CONSULTANTS, LP, FOR <br />THE PROVISION OF PROFESSIONAL GEOTECHNICAL SERVICES IN CONNECTION WITH <br />THE RIO VISTA DAM MAINTENANCE AND WHITEWATER IMPROVEMENTS PROJECT, <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THIS AGREEMENT ON BEHALF OF <br />THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Diaz moved for adoption of the Resolution, and Mr. Thomaides seconded <br />the motion. Mr. Bose stated he pulled this item by mistake. The Council <br />then voted unanimously for adoption of the Resolution. <br />Mayor Narvaiz introduced for consideration Item 28, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AGREEMENT BETWEEN THE CITY AND RECREATIONAL ENGINEERING <br />AND PLANNING, INC. FOR THE PROVISION OF PROFESSIONAL CONSULTING <br />SERVICES IN CONNECTION WITH THE RIO VISTA DAM MAINTENANCE AND <br />WHITEWATER IMPROVEMENTS PROJECT; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br />Mr. Jones moved for adoption of the Resolution, and Mr. Guerrero seconded <br />the motion. Mr. Bose inquired as to the status of the project. Mr. <br />O'Leary stated this project has been split into two projects, which he <br />calls the river project and the river bank project. He stated all the <br />regulatory agencies have been contacted regarding the necessary permits. <br />He also stated the dirt work should begin within the next two weeks. <br />Rodney Cobb, Director of Parks and Recreation Department, stated the <br />permits should be issued on March 1, 2006 and the major work will begin <br />once they have received the permits. Mr. Mihalkanin stated he is concerned <br />with two separate companies doing the project. He stated he wants to make <br />sure both contracts coordinate the responsibilities so the City is <br />protected from contractor's defective construction or design. Mayor <br />Narvaiz stated she agrees the City needs to be protected and not left at <br />risk from contractor's defective construction or design. Mr. Mihalkanin <br />inquired as to the guarantee of the construction and/or design. Mr. Taylor <br />stated usually a one year guarantee is written in the contract. He stated <br />there are some engineering contracts which provide a longer warranty. He <br />stated a second engineering contract and construction contract will come <br />before the Council at the Regular Meeting scheduled for February 21, 2006. <br />Mr. Mihalkanin stated he feels Staff should contact other municipalities to
