The Council then voted <br />of the Resolution. <br />for consideration Item 18, removed from the <br />of a Resolution, the caption which was read as <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />GRANTING RECOGNITION OF THE SAN MARCOS PROFESSIONAL FIREFIGHTERS <br />ASSOCIATION LOCAL #3963 AS THE SOLE AND EXCLUSIVE BARGAINING AGENT FOR <br />CITY FIREFIGHTERS, AND DETERMINING THAT THE CITY MAY MEET AND CONFER <br />WITH THE ASSOCIATION WITHOUT CONDUCTING AN ELECTION BY THE VOTERS IN <br />THE CITY; GRANTING RECOGNITION OF THE SAN MARCOS POLICE OFFICERS <br />ASSOCIATION AS THE SOLE AND EXCLUSIVE BARGAINING AGENT FOR CITY POLICE <br />OFFICERS, AND DETERMINING THAT THE CITY MAY MEET AND CONFER WITH THE <br />ASSOCIATION WITHOUT CONDUCTING AN ELECTION BY THE VOTERS IN THE CITY; <br />DIRECTING THE CITY MANAGER TO SUBMIT A REPORT ON THE STATUS OF MEET <br />AND CONFER; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Mihalkanin moved for adoption of the Resolution, and Mr. Jones seconded <br />the motion. Mr. O'Leary provided a powerpoint regarding the Meet and <br />onfer law passed by the Texas Legislature. Mayor Narvaiz stated six <br />onths ago the Council received some education information regarding the <br />egislative changes. She stated the Council also discussed the Meet and <br />Confer during the Visioning Workshop and again in Executive Session. Mr. <br />Thomaides inquired as to the reason why one Association in Texas withdrew <br />their petition. Mr. O'Leary stated Big Spring Fire Association withdrew <br />their petition because the Council had ordered a certification election to <br />determine whether the Association represented the majority of the Fire <br />Association. Mr. Jones inquired whether the salary market has been <br />investigated. Mr. O'Leary stated a pay wage study is conducted every two <br />years. He stated our police officers and firefighters are not the highest <br />paid, nor are they the lowest paid in Texas. Mr. Guerrero stated he is <br />interested in recognizing both the Fire and Police Association. He stated <br />he feels if this is not done, the City could lose good employees. Mr. Bose <br />stated he agrees with Mr. Guerrero, but is concerned with the impact this <br />can have on the budget. Mr. O'Leary stated if the Council chooses to <br />recognize the Fire and Police Association, then the Council and <br />Associations may negotiate terms. Mayor Narvaiz stated she supports <br />recognizing the Fire and Police Associations. She stated after the Council <br />begins to negotiate the terms and conditions with the Fire and Police <br />Associations, the Council can still choose to undo the decision with a 90- <br />ay notice. Mr. Mihalkanin stated he supports recognizing the Fire and <br />olice Associations. He stated he feels this Resolution should be adopted <br />eparately, one for each Association. Mr. Thomaides stated he supports <br />ecognizing the Fire and Police Associations. He inquired why only 78% of
