<br />Regular Meeting <br /> <br />December 6, 2004 <br /> <br />7. <br />Page 5 <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE RELEASE OF A PUBLIC UTILITY EASEMENT LOCATED IN LOT <br />34R, BLOCK P OF THE HUGHSON HEIGHTS ADDITION, SECTION 3-C, LOCATED <br />AT 832/834 SAGEWOOD TRAIL, TO THE NATIONAL CITY MORTGAGE COMPANY; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE A RELEASE; AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Thomaides moved for approval of the Ordinance on first reading, and <br />Mr. Guerrero seconded the motion. Mr. Bose stated he feels an <br />inspection should be done so buildings are not built on easements. <br />Carol Barrett stated currently a legal survey is not required when <br />obtaining a permit for improvements. Mr. Thomaides stated the property <br />encroachment is 2 ~'. Ms. Barrett stated the homeowner is requesting <br />all 5' of the easement. She stated Staff has no reason to retain the <br />remaining 2 ~'. Mr. Mihalkanin stated he would like information <br />regarding other properties in this neighborhood with the same <br />encroachment situation. The Council then voted unanimously for approval <br />of the Ordinance on first reading. <br /> <br />I <br /> <br />Mayor Narvaiz introduced for consideration adoption of a Resolution, the <br />caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL <br />AWARDING A CONTRACT TO <br />CENTER PROJECT; AUTHORIZING THE <br />CONTRACT DOCUMENTS ON BEHALF OF <br />EFFECTIVE DATE. <br /> <br />OF THE CITY OF SAN MARCOS, TEXAS, <br />FOR THE ALERRT TACTICAL COMBAT <br />CITY MANAGER TO EXECUTE THE <br />THE CITY; AND DECLARING AN <br /> <br />Mr. Thomaides moved for adoption of the Resolution with the amendment of <br />D. L. Bandy Construction of San Marcos, Texas, to be awarded the <br />contract, and Mr. Diaz seconded the motion, which passed unanimously. <br /> <br />I <br /> <br />Mayor Narvaiz introduced for consideration approval of minutes of the <br />Regular Meeting held November 22, 2004, approval of one Ordinance on <br />second reading, adoption of two Ordinances on third and final reading, <br />and adoption of seventeen Resolutions, on consensus. The Council <br />removed Items 18 and 32, adoption of Resolutions, to be considered <br />separately. Mr. Mihalkanin moved for approval of minutes of the Regular <br />Meeting held November 22, 2004, approval of one Ordinance on second <br />reading, adoption of two Ordinances on third and final reading, and <br />adoption of the remaining fifteen Resolutions, by consensus, and Mr. <br />Thomaides seconded the motion, which passed unanimously.
