<br />82. <br /> <br />Regular Meeting <br /> <br />December 13, 2004 <br /> <br />Page 5 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />CHANGING THE NAME OF RAILROAD STREET, FROM ITS INTERSECTION WITH WEST <br />MARTIN LUTHER KING DRIVE TO ITS INTERSECTION WITH WEST SAN ANTONIO <br />STREET, TO ARMSTEAD STREETj INCLUDING PROCEDURAL PROVISIONSj AND <br />DECLARING AN EMERGENCY. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. <br />Thomaides moved for adoption of the Ordinance on emergency, and Mr. <br />Guerrero seconded motion, which passed unanimously. <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and adoption <br />of a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ASSIGNING INITIAL <br />ZONING OF "RR" RURAL RESIDENTIAL DISTRICT TO ALL LOTS IN BLOCK A <br />THROUGH F OF SECTION 11, AND BLOCKS A THROUGH D OF SECTION 12, WILLOW <br />CREEK ESTATES SUBDIVISIONj INCLUDING PROCEDURAL PROVISIONSj AND <br />PROVIDING FOR PENALTIES. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. <br />ITaYlor moved for adoption of the Zoning Ordinance, and Mr. Guerrero <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Narvaiz introduced a public hearing to receive citizen comment on <br />the Community Development Block Grant (CDBG) 2003 Consolidated Annual <br />Performance and Evaluation Report (CAPER). Mayor Narvaiz opened the <br />public hearing and asked if anyone wished to speak. No one did, so Mayor <br />Narvaiz closed the public hearing. <br /> <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE ELECTING FOR THE CITY TO MAKE CURRENT SERVICE AND PRIOR <br />SERVICE CONTRIBUTIONS TO THE CITY'S ACCOUNT IN THE MUNICIPAL <br />ACCUMULATION FUND OF THE TEXAS MUNICIPAL RETIREMENT SYSTEM AT THE <br />ACTUARIALLY DETERMINED RATE OF TOTAL EMPLOYEE COMPENSATIONj DECLARING <br />AN EMERGENCYj AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Taylor moved for adoption of the Ordinance on emergency, and Mr. <br />Guerrero seconded the motion. Mr. O'Leary stated the contribution rate <br />for TMRS benefits will exceed a statutory maximum, which has been in place <br />Ifor many years. He stated TMRS has recommended cities remove the limit to <br />permit paying the actual determined rate, which will ensure proper funding <br />of the City's benefit plan.
