<br />I <br /> <br />SECTION 9. Section 42.053 of the City Code is amended as follows <br />(underlining indicates added text; overstrike indicates deleted text): <br /> <br />Sec. 42.053. Terms of office. <br /> <br />W The seven members of the historic preservation commission shall serve three- <br />year staggered terms, with three members being appointed in January of one year, <br />two members appointed in January of the next year, and two members being <br />appointed in January of the following year. <br /> <br />(b) .\n appointment to fill a vacancy shall be for the unexpired term. <br /> <br />SECTION 10. To effect the changes made to the appointment process by this <br />ordinance, the City Council wishes to change the terms of certain board and commission <br />members as follows: <br /> <br />A. The terms of office of all board and commission members that are currently <br />due to expire between November 1,2004 and October 31, 2005 shall expire on December <br />31,2004; <br /> <br />I <br /> <br />B. The terms of office of all board and commission members that are currently <br />due to expire between November 1, 2005 and October 31, 2006 shall expire on December <br />31,2005; <br /> <br />C. The terms of office of all board and commission members that are currently <br />due to expire between November 1, 2006 and October 31, 2007 shall expire on December <br />31, 2006; and, <br /> <br />D. The term of office of any board or commission member that commenced prior <br />to November 1, 2004 and is due to expire after October 31, 2007 shall expire on <br />December 31 of the year prior. <br /> <br />SECTION 11. If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, <br />the other provisions of this ordinance will continue in force if they can be given effect <br />without the invalid portion. <br /> <br />SECTION 12. All ordinances and resolution or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br />SECTION 13. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Clerk will publish notice of its adoption in a newspaper of general <br />circulation in the City. <br /> <br />I <br /> <br />PASSED AND APPROVED on first reading September 27, 2004. <br /> <br />5 <br />
