Regular Meeting November 8, 2004 Page 15 IMaYOr Narvaiz introduced for consideration Item 32, removed from the consent agenda, adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, RATIFYING THE AWARD AND EXECUTION OF A CONTRACT WITH ENVIROSOLVE, LLC, FOR HOUSEHOLD HAZARDOUS WASTE DISPOSAL SERVICES; RATIFYING THE PURCHASING MANAGER'S EXECUTION OF THE APPROPRIATE PURCHASING DOCUMENTS ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. Mr. Guerrero moved for adoption of the Resolution, and seconded the motion. Mr. Thomaides inquired whether the hazardous waste disposal this year. Mr. Thomaides City had more this year the The Council Mayor Narvaiz introduced for consideration Item 34, removed from the consent agenda, adoption of a Resolution, the caption which was read as follows: I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AMENDED AGREEMENT WITH THE SAN MARCOS HISPANIC CHAMBER OF COMMERCE FOR A MINORITY ECONOMIC DEVELOPMENT PROGRAM FOR FISCAL YEAR 2004-2005; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; AND DECLARING AN EFFECTIVE DATE. Mayor Narvaiz introduced an Executive Session pursuant to the Government Code, Section 551.071, to seek the City Attorney's advice regarding pending litigation, contemplated litigation, a settlement offer, or a matter involving attorney-client privilege (Hispanic Chamber of Commerce economic and tourism development contracts). Mr. Mihalkanin moved the Council adjourn into Executive Session at 10:14 p.m. and Mr. Guerrero seconded the motion, which passed unanimously. Mr. Mihalkanin moved the Council reconvene at 10:40 p.m. and Mr. Guerrero seconded the motion, which passed unanimously. Mr. Mihalkanin moved for adoption of the Resolution, with amendments provided by Mr. Mark Taylor in Memo dated November 8, 2004, and Mr. Guerrero seconded the motion. Mr. Thomaides inquired whether the Hispanic Chamber can provide an audit by January 31, 2005. Richard Garza, Hispanic Chamber President, stated he has spoken to several audit firms, which stated they could complete an audit by January 31, 2005. Mr. Thomaides Imoved to amend 8. Miscellaneous to read ...no later than February 15, 2005, and Mr. Guerrero seconded the motion. On roll call the following vote was recorded: AYE: Diaz, Guerrero, Mihalkanin, Narvaiz, Thomaides and Bose.
