<br />I <br /> <br />1.3.1 Prepare an application to the City for the creation of a Redevelopment Authority (the <br />"Authority") . <br /> <br />1.3.2 Prepare a resolution for the TIRZ Board to adopt related to the creation of the Authority pursuant <br />to Chapter 43 I ofthe Texas Transportation Code, and 396 of the Texas Local Government Code <br /> <br />1.3.3 Prepare draft Articles of IncorporatIon and Bylaws for the AuthorIty for review by the City staff <br />and the TIRZ Board, and file all reqUIred documents for the creatIon of the Authonty With both the City <br />and the Texas Secretary of State. <br /> <br />1.3.4 Attend an organizational meeting of the governl11g body of the Authority, and provide orientation <br />to the governing body on the TIRZ, the Final Project Plan and Final Financing Plan, and the nature and <br />purposes of the Authority. <br /> <br />1.3.5 Prepare a tri-party agreement between the City, the TIRZ, and the Authority, and submit the <br />agreement to the City for review and approval. The agreement will set forth the terms under which the <br />AuthOrity will act on behalf of both the City and the TlRZ to Implement the Fl11al Project Plan and the <br />Final Financing Plan. <br /> <br />1.3.6 Upon receipt of the City's approval, present the tri-party agreement to the Authority's Board, <br />clarify any issues related to the agreement and the role of the Authority vis-a-vis the TIRZ, and secure <br />Authority Board approval of the agreement. <br /> <br />1.3.7 Submit the tri-party agreement to the City's Legal Department for presentation to the City <br />Council. Work with the City to secure City Council approval of the agreement. <br /> <br />I <br /> <br />1.4 Public Improvement District Creation <br /> <br />Note: The City's engagement of the Consultant for these serVices, and the compensation to be paid to the <br />Consultant, will be determined by the partIes 111 an amendment to thiS Agreement. ThiS deSCription of <br />services may be modified 111 that amendment <br /> <br />The Consultant will: <br /> <br />1.4.1 Prepare a petition to be signed by property owners of record requesting the creation of a Public <br />Improvement District ("PID"). <br /> <br />1.4.2 Prepare a proposal document in accordance with Chapter 372 of the Local Government Code <br />which includes the general nature of the proposed improvements, the estimated cost of the improvements, <br />the boundanes of the proposed assessment district, the proposed method of assessment, the proposed <br />apportionment of cost between the PID and the City, and whether the management of the distnct IS to be <br />by the City, pnvate sector, or a partnership between the two. <br /> <br /> 1.4.3 <br /> 1.4.4 <br />I 1.4.5 <br />1 4.6 <br /> <br />Prepare a public notice for the purpose of conductll1g a public hearing to create a PID, <br /> <br />Prepare a PID Service and Assessment Plan and a proposed and final Assessment Role. <br /> <br />Prepare appropriate documents to create a development authority. <br /> <br />Prepare Development Agreement for review by the City's Attorney <br /> <br />4 <br />
