<br />I <br /> <br />I <br /> <br />I <br /> <br />the TIRZ. These presentations are required by the Act and must be made prior to the City's creation of <br />the TIRZ. The Consultant will attempt to conduct a single briefing with all jUrIsdictIOns if possIble. If <br />necessary, the Consultant will conduct the required briefing before each body independently. <br /> <br />1.1.13 Assist the City in conducting the public hearIng on the creation of the TIRZ. It is anticipated that <br />the public hearing will be held before the City Council, in which case the Consultant Will be present to <br />serve as technical advisor to the City during the hearing. The City may request, however, that the <br />Consultant conduct the hearing on the City's behalf. <br /> <br />1.2 Creation of the Tax Increment Reinvestment Zone <br /> <br />The Consultant will: <br /> <br />1.2.1 Prepare and delIver to the City's Legal Department a draft creation ordinance for the TIRZ. The <br />ordinance will make all the required statutory findings and other content, and be accompanied by the final <br />Preliminary Project Plan and the final Preliminary Financing Plan, all exhibits and other information, as <br />required by the Act. <br /> <br />1.2.2 Work with the City and the owner/developer of the bulk of the TIRZ area (the "Developer") to <br />nominate and appoint the TIRZ Board of Directors (the "TIRZ Board"). <br /> <br />1.2.3 Present the final Preliminary Project Plan and the final Preliminary Financing Plan to the TIRZ <br />Board Based on Input from the TIRZ Board, the Consultant will prepare a final Project Plan (the "Final <br />Project Plan") and final FlIlancing Plan (the "Final Financing Plan") for presentation to the TIRZ Board. <br />Should any changes to either plan be required based on the public hearIng process, the Consultant will <br />incorporate the necessary changes into the plan document(s) and present them to the TIRZ Board for its <br />consideration and approval. <br /> <br />1.2.4 Prepare and submit to the City's Legal Department an ordinance to approve the Project Plan and <br />Financing Plan. <br /> <br />1.2.5 Transmit the approved plans to all taxing jurisdictions. <br /> <br />1.26 Negotiate final participation agreements with other taxing jurisdictions. The Consultant will <br />insure that each agreement sets forth the rate of participation for the jUrisdiction, the term of the <br />agreement, and any special negotiated proVISIons reqLllred by the JUrIsdiction for their partIcipation in the <br />TIRZ. <br /> <br />1.2.7 Present agreements to the TIRZ Board for approvaL <br /> <br />1.2.8 Prepare and submit ordinances to the City's Legal Department to approve the partiCipation <br />agreements with other taxing jurisdictions. <br /> <br />1.3 Creation of the Redevelopment Authority <br /> <br />Note: The CIty's engagement of the Consultant for these services, and the compensation to be paid to the <br />Consultant, will be determllled by the parties 111 an amendment to this Agreement.
