<br />114. <br /> <br />Regular Meeting <br /> <br />November 22, 2004 <br /> <br />Page 2 <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and adoption <br />of a Zoning Ordinance, the caption which was read as follows: I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 2.75 ACRE <br />TRACT OF PROPERTY FROM "M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD <br />BUSINESS DISTRICT TO "TH-1" TOWNHOUSE RESIDENTIAL DISTRICT (LOW <br />DENSITY) LOCATED AT 1517 AND 1519 POST ROAD; AND PROVIDING FOR <br />PENALTIES. <br /> <br />A petition was filed by a minimum of 20% of the property owners, requlrlng <br />a Council % vote by City Council to approve this rezoning. Mayor Narvaiz <br />opened the public hearing and asked if anyone wished to speak. 1) Ray <br />Raybold read a letter from Dorothy Rudisill opposing the rezoning. He <br />stated he also opposes this rezoning. 2) Ronda Reagan stated she supports <br />this rezoning. She stated she feels this property should be designated <br />for young professionals. She stated she feels San Marcos needs more <br />housing for young professionals. 3) Shelton Eubanks stated he opposes this <br />rezoning. He stated he has a lot of traffic by his house and feels this <br />rezoning would cause more traffic. 4) Gwen Vinson stated she opposes this <br />rezoning. She encouraged the Council to think of safety issues this <br />rezoning will cause. 5) Cheryl Eubanks stated she opposes this rezoning. <br />She stated these are not tracts; these are homes where people live. Mayor I <br />Narvaiz asked if anyone else wished to speak. No one did, so Mayor <br />Narvaiz closed the public hearing. Mr. Thomaides moved for adoption of the <br />Zoning Ordinance, and Mr. Guerrero seconded the motion. Mr. Bose <br />inquired as to the drainage in this area. Carol Barrett, Director of <br />Planning, stated the drainage proposal has not been submitted to Planning <br />and Zoning. She stated she feels a detention pond or a common open area <br />would need to occur in this area. Mr. Bose inquired whether the service <br />road would need to be widened. Ms. Barrett stated this rezoning is for <br />townhomes, which will have rear entry garages. Mr. Taylor stated the <br />Planning and Zoning Commission approved this project 7-0. Mr. Thomaides <br />inquired as to the zoning of this area. Ms. Barrett stated some of the <br />homes are zoned "R-l" , "M" and one lot is mobile home. Mr. Thomaides <br />stated he has some concerns with the garages facing another neighborhood. <br />On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Diaz, Narvaiz and Taylor. <br /> <br />NAY: <br /> <br />Guerrero, Mihalkanin, Thomaides and Bose. <br /> <br />ABSTAIN: None. <br /> <br />Adoption of the Zoning Ordinance failed. <br /> <br />I <br />
