I

I

I

of the rights granted to GBRA, its successors and assigns herein. Upon one

hundred and eighty (180) days notice, GBRA will, at their expense, protect their

pipeline by installing casing or by other means for driveways and roadways to

be constructed by GRANTOR on the property described in Exhibits "A", "B",

"C" and "D" herein.

6. During the period of construction of the said pipeline, GBRA may construct

such temporary fences as are required by its contractor or engineers and if such

fences are constructed, GBRA will allow access, and ingress and egress across

the PROPERTY to GRANTOR.

7. During the period of construction and during the period of any maintenance of

the pipeline that requires disturbance of the surface, and until surface vegetation

has been restored, GBRA shall install and maintain effective temporary methods

and practices to prevent soil erosion and degradation in the quality of surface

water runoff. GBRA shall promptly remove the temporary methods and

practices, and restore the surface area upon completion of the construction or

maintenance activity.

8, After construction of the said pipeline, and after any maintenance of the pipeline

that requires disturbance of the surface, GBRA shall restore the surface as nearly

as practicable to its original condition, so as not to affect normal drainage.

GBRA shall use the method of "double ditching" so that the surface soil will be

separated, retained, and replaced as the top layer of the soil. GBRA shall reseed

the surface soil and insure proper watering during dry weather until the native

grass has grown,

PIPELINE EASEMENT (Treated Water) 6/02
