GBRA shall have the right to use existing roadways and driveways for access to <br /> <br />the pipeline, provided GBRA shall repair any damages to the roadway that <br /> <br />occurs in connection with GBRA's use of the roadway or its construction, <br /> <br />operation and maintenance of the pipeline. GBRA acknowledges that the <br /> <br />GRANTOR may implement and enforce reasonable security measures and <br /> <br />protocols related to access to the pipeline, and GBRA agrees to comply with <br /> <br />such measures and protocols. <br /> <br />14. GBRA agrees that it shall be responsible for bearing all costs related to its <br /> <br />compliance with the terms and conditions of this easement. <br /> <br />I <br /> <br />15. To the extent applicable by law, GBRA and its successors and assigns shall <br /> <br />indemnify, defend and hold GRANTOR and its successors and assigns from and <br /> <br />against all claims, liability, suits, actions, costs and expenses of whatsoever <br /> <br />nature (including reasonable attorneys fees) for injuries to persons or damage to <br /> <br />property caused by the exercise of rights hereunder by GBRA or its employees, <br /> <br />agents or contractors, or the failure to comply at all time with all applicable <br /> <br />federal, state and local laws, rules, regulations and safety standards in <br /> <br />connection with constructing, using, operating, maintaining and/or servicing <br /> <br />facilities within the PROPERTY. <br /> <br />I <br /> <br />PIPELINE EASEMENT (Treated Water) 6/02 <br /> <br />Page 7 of 10 <br />
