43. <br />Regular Meeting February 10, 2003 Page 4 <br /> <br />for adoption of the Resolution (Mr. Taylor was not present to vote on this <br />item). <br /> <br />Mayor Pro-Tem Mayhew introduced for consideration a public hearing and <br />adoption of a Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN PLARCOS, TEXAS, <br />APPROVING THE TERi~S AND CONDITIONS OF A PROPERTY USE AGREEMENT BETWEEN <br />THE CITY AND SOUTHWEST TEXAS STATE UNIVERSITY FOR THE CITY'S USE OF A <br />PARKING AREA DOWNTOWN AND THE UNIVERSITY'S USE OF A PARKING AREA ALONG <br />BOBCAT DRIVE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON <br />BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Pro-Tem Mayhew opened the public hearing and asked if anyone wished to <br />speak. 1) Lupe Carbajal stated he is the President of the Downtown <br />Association. He stated he encouraged the City to make the property switch. <br />Mayor Pro-Tem Mayhew asked if anyone else wished to speak. No one did, so <br />Mayor Pro-Tem Mayhew closed the public hearing. Mr. O'Leary stated the <br />newspaper did not print the public hearing notice so staff requested this <br />item be tabled until the next Regular Meeting scheduled for February 24, <br />2003. Ms. Narvaiz moved to table the Resolution, and Ms. Tatum seconded the <br />motion. On roll call the following vote was recorded: <br /> <br />AYE: Montoya, Narvaiz, Mayhew and Tatum. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Mihalkanin and Habingreither (disclosure affidavits-business <br /> entity filed with City Clerk). <br /> <br />Item 9, consideration of the Election Ordinance on emergency, was delayed <br />for consideration until later in this meeting (see page 7). <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />DEDICATING A TRACT OF REAL PROPERTY FOR PUBLIC STREET PURPOSE AS AN <br />EXTENSION OF PROGRESS STREET; AND INCLUDING PROCEDUKAL PROVISIONS. <br /> <br />Mr. Mihalkanin moved for approval of the Ordinance on the first reading and <br />Mr. Mayhew seconded the motion. Mr. O'Leary stated this is a 50' strip with <br />no public access. This would make the strip a dedicated street. The <br />Council then voted unanimously for approval of the Ordinance on first <br />reading (Mr. Taylor was not present to vote on this item). <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br /> <br />
