<br />-3- <br /> <br />shall pay any and all utility bills for service to the demised <br />premises. <br /> <br />VII. <br />All covenants, terms and conditions of this Agreement of <br />Lease must be approved by the Federal Aviation Administration be- <br />fore the effective date of the lease. <br /> <br />VIII. <br /> <br /> <br />During the term of this Agreement of Lease, Lessor agrees <br /> <br /> <br />Lessee shall have unrestricted access to the runways, taxiways <br /> <br />and ramps now in existence at said Airport to the same extent <br /> <br />that any other parties may have use thereof. It is understood <br /> <br />and agreed by and between Lessor and Lessee that the continuing <br />use of said Airport as an airport for general aviation is essential <br />to the operation of Lessee and that the failure to continue the <br />use of said Airport for airport and aviation purposes shall constitute <br />a default in the Agreement. Upon Lessee giving written notice of <br />such default to Lessor and upon the failure of Lessor to cure such <br />default within thirty (30) days after the receipt of said written <br /> <br /> <br />notice, this Agreement shall terminate and end as of the date one <br /> <br /> <br />hundred and twenty (120) days after the receipt of said written <br /> <br /> <br />notice. Lessee shall thereupon be released from and relieved of <br /> <br />all further obligations thereafter to accure hereunder. <br /> <br />IX. <br /> <br />Maintenance of the runways, taxiways, entrance roads, drive- <br /> <br />ways and existing parking lots leading to and/or contiguous to the <br />demised premises, and unoccupied property of said Airport, except <br />for the demised premises shown on Exhibit A of this Agreement, shall <br /> <br /> <br />remain the obligation of Lessor; provided, however, that Lessor <br /> <br /> <br />shall only be obligated to use airport revenue funds for such pur- <br /> <br /> <br />poses and that Lessor shall never have the obligation to use general, <br /> <br />operating or bond funds for the purpose of said maintenance. <br />
