<br />69 <br /> <br /> <br /> <br /> <br />ORDINANCE NO. 1982-5 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, DESIGNATING A TRACT OF <br />LAND LOCATED IN THE EXTRATERRITORIAL JURISDIC- <br />TION OF THE CITY OF SAN MARCOS, TEXAS, SAID <br />TRACT BEING 78.23 ACRES OF LAND OUT OF THE J.M. <br />VERAMENDI LEAGUE NO. 1,AS AN INDUSTRIAL DISTRICT, <br />TO BE KNOWN AS "THE CITY OF SAN MARCOS INDUSTRIAL <br />DISTRICT", AS PROVIDED FOR BY THE TEXAS MUNICIPAL <br />ANNEXATION ACT; DECLARING THE PURPOSE FOR SUCH <br />DISTRICT AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, Section 5 of the Texas Municipal Annexation Act, <br />Article 970a, Texas Revised Civil Statutes, provides for the <br />establishment of industrial districts by municipalities within <br />their extraterritorial jurisdiction; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />deems it to be to the advantage of the citizens of ~an Marcos <br />to take advantage of such provision; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the following described unincorporated area <br />is hereby designated as an industrial district of the City of <br />San Marcos, Texas, to-wit: <br /> <br />78.23 acres of land out of the J.M. Veramendi League <br />No.1, Hays County, Texas. Being a portion of that <br />79.10 acre tract of land conveyed to W.P. Donalson <br />Jr., by W.P. Donalson, Sr., by deed dated January 18, <br />1956 and recorded in Volume 167, page 87, Hays County <br />Deed Records and being more particularly described <br />by metes and bounds as follows, to-wit: <br /> <br />BEGINNING at an iron stake set under fence on the <br />Northeast line of the said Donalson tract, at its <br />intersection with the Southeast line of R.M. Highway <br />No. 2439, for the North corner of the tract herein <br />described, and from which an iron stake found at the <br />base of a corner fence post bears N 450 16' W, 2.25 <br />feet; <br /> <br />THENCE, leaving the said R.M. Highway No. 2439, with <br />fence the Northeast line of the said Donalson tract, <br />the following courses numbered (1) through (4): <br /> <br />(1) S 430 26' E, 191.15 feet to a fence post; <br />U) S 450 17' E, 858.63 feet to a fence post; <br />(3) S 450 33' E, 620.78 feet to a fence post; <br />(4) S 460 22' E, at 423.67 feet passing the North- <br />west line of a 20 foot wide Easement conveyed to South- <br />western Bell Telephone Co. by W.P. Donalson, Jr. by <br />deed dated October 28, 1966, and recorded in Volume <br />214, page 404, Hays County Deed Records, at 442.8 feet <br />passing a corner fence post and continuing on in all, <br />443.67 feet to an iron stake set on the Northwest line <br />of a 100 foot wide Missouri and Pacific Railroad Right <br />of Way at the East corner of the said Donalson tract, <br />for the East corner of the tract herein described, same <br />being on the Southeast line of the said Southwestern <br />Bell Telephone Co. 20 foot easement; <br /> <br />THENCE, with the Northwest line of the said Missouri and <br />Pacific Railroad Right of Way, the Southeast line of <br />the said Southwestern Bell Telephone Co. 20 foot Ease- <br />ment, S 470 13' W, 1668.62 feet to an iron stake set <br />
