<br />under fence at the South corner of the said Donalson <br />tract, for the South corner of the tract herein <br />described, and from which an iron stake found at <br />the base of a corner fence post bears, S 450 15' E, <br />1. 90 feet; <br /> <br />THENCE, leaving the said Missouri and Pacific Railroad <br />Right of Way, with fence, the Southwest line of the <br />said Donalson tract, the following courses numbered <br />(5) through (8): <br /> <br />(5) N 450 15" W, at 20 feet passing the aforementioned <br />Northwest line of the said Southwestern Bell <br />Telephone Co. 20 foot Easement and continuing <br />on in all, 877.28 feet to a fence post; <br />(6) N 440 49' W, 543.33 feet to a fence post; <br />(7) N 450 13' W, 281.27 feet to a fence post in <br />a rock wall; <br />(8) N 450 57' W, at about 225 feet passing a 14 <br />inch Elm tree, leaving the said rock wall and con- <br />tinuing on with fence, 252.01 feet to the remains <br />of a concrete encasement for a corner fence post on <br />the arc of a curve to the right on the aforementioned <br />Southeast line of the said R.M. Highway No. 2439, for <br />the West corner of the tract herein described; <br /> <br />THENCE, with the Southeast line of the said R.M. High- <br />way No. 2439, the following courses numbered (9) and <br />(10) : <br /> <br />(9) 355.41 feet along the arc of the said curve <br />to the right, having a radius of 1105.92 <br />feet and a sub-chord which bears, N 340 27' <br />E, 353.88 feet to a concrete monument found <br />at the POINT OF TANGENCY; <br />(10) N 430 39' E, at 1128.58 feet passing a concrete <br />monument found and continuing on in all, 1311.72 feet <br />to the POINT OF BEGINNING containing 78.23 acres of <br />land. <br /> <br />SECTION 2. That it is hereby declared to be the purpose of <br />the City Council of the City of San Marcos to treat with such <br />area above designated, from time to time, as said City Council <br />may deem to be in the best interest of the City of San Marcos, <br />and to enter into contracts or agreements with the owner or <br />owners of land in said industrial district to guarantee the <br />continuation of the extraterritorial status of said district and <br />its immunity from annexation by the City of San Marcos for a <br />period of time not to exceed seven years, and upon such other <br />terms and consideration as the parties may deem appropriate. <br /> <br />SECTION 3. That any contract or agreement made pursuant <br />to the City's power and authority under Se~tion 5 of the Texas <br />Municipal Annexation Act shall be evidenced in writing and may <br />be renewed or extended for successive periods not to exceed seven <br />years each upon agreement of the City of San Marcos and the owner <br />of the land in the industrial district. <br /> <br />SECTION 4. That the industrial district created and established <br />by this ordinance shall be known as "The City of San Marcos Indus- <br />trial District." <br /> <br />SECTION 5. That the importance of this Ordinance creates an <br />emergency and an imperative purpose necessary that the provisions <br />of the charter requiring that ordinances shall be read at three <br />separate meetings and that no ordinance shall become effective until <br />
