<br />94 <br /> <br />THE STATE OF TEXAS <br /> <br />INDUSTRIAL DISTRICT AGREEMENT <br /> <br />COUNTY OF HAYS <br /> <br />In order to promote and protect the general health, safety <br /> <br /> <br />and welfare of persons residing and owning property within and <br /> <br /> <br />adjacent to the City of San Marcos, Texas, and for the further <br /> <br /> <br />purpose of encouraging the development of clean manufacturing <br />and industrial facilities within the San Marcos area, and <br />pursuant to the provisions of Article 970a, Texas Revised Civil <br />Statutes, the City of San Marcos, Texas, a municipal corporation <br />of Hays County, Texas, existing by and under the laws of the <br />State of Texas, acting through authority conferred on its Mayor, <br />Emmie Craddock, by Ordinance duly adopted on <br />hereinafter "City", and National Supply Company, Division of <br />Armco, Inc.,a Texas corporation with principle offices in Houston, <br /> <br />Harris County, Texas, hereinafter called "Company", do hereby <br /> <br />contract and agree as follows: <br /> <br />I. <br />City hereby agrees that all of the land and improvements <br />thereon owned, used, occupied or possessed by Company within <br />the area heretofore designated by ordinance as The City of San <br />Marcos Industrial District, a copy of which ordinance is attached <br />hereto and made a part of this Agreement, shall continue its <br />extraterritorial status as an industrial district and shall not <br />be annexed by City prior to February, 1983. <br /> <br />II. <br /> <br /> <br />Company agrees that the initial investment of Company <br /> <br />shall be in an amount of not less than twenty (20) million dollars, <br /> <br />said investment to consist of real, fixed and equipment assets. <br /> <br />III. <br />Utilities shall be provided pursuant to the following <br />
