<br />Tenant covenants and agrees to keep said premises and Improve-
<br />ments situated thereat free and clear of any and all liens any way
<br />ar ising au t 0 f the us e the reo f h Y tenan t.
<br />
<br />Tenant shall assume all risks incident to or in connection with
<br />the business to be conducted hereunder and shall be solely responsible
<br />for all accidents or injuries of whatever nature or kind to persons or
<br />property caused by its operations at said airport and shall indemnify,
<br />defend and save harmless the landord, its authorized agents and repre-
<br />sentatives, from any penalties for violation of any law, ordinance or
<br />regulation affecting its operations, and from any and all claims, suits
<br />losses, damages or injuries to persons or property of whatsoever kind
<br />or nature arising directly or indirectly out of the operation of such
<br />business or resulting from the carelessness, negligence or improper
<br />conduct of the landlord, tenant, or any of their agents or employees.
<br />
<br />Landlord shall not be liable to tenant for damage to property of
<br />tenant or any loss of revenues to tenant resulting from landlord's
<br />acts, omission, or neglect in the maintenance and operation of the
<br />airport facilities.
<br />
<br />Article VII
<br />
<br />Damage to, or Destruction of Premises
<br />
<br />In the event the premises or the building of which the premises
<br />are a part shall be damaged or destroyed by fire or other casualty,
<br />the same may be promptly repaired or rebuilt by landlord as soon as
<br />funds are available but landlord shall not be obligated to repair,
<br />rebuild, restore or replace any fixtures, equipment, displays or
<br />other property installed by tenant pursuant to this agreement.
<br />
<br />Provided, however, that landlord may elect, at its sole option,
<br />not to repair or reconstruct the premises or the building, of which
<br />the premises are a part, and upon written notice of such election
<br />from landlord to tenant the obligation of tenant to pay rent shall
<br />cease and this agreement shall thereupon terminate.

<br />Article VIII
<br />
<br />Access, Ingress, and Egress
<br />
<br />Landlord hereby grants to tenant the right of access and ingress
<br />to and egress from the premises by tenant and its employees, contrac-
<br />tors, suppliers, servicemen, guests, patrons and invitees; provided,
<br />that such rights of access, ingress and egress, are at all times
<br />exercised in conformance with the provisions of this agreement and
<br />any and all regulations promulgated by landlord, or other lawful
<br />authority, for the care, operation, maintenance and protection of the
<br />airport and the public.

<br />Article IX
<br />
<br />Nonrecording
<br />
<br />This agreement shall not and will not, nor shall any copy thereof,
<br />or any statement, paper or affidavit in any way or manner referring
<br />hereto, be filed in the office of the County Clerk of Caldwell County,
<br />Texas, or in any other public office, by tenant or anyone acting for
<br />tenant and that if the same be so filed, this agreement and each and
<br />every provision hereof shall, at the option of the landlord, be and
<br />become absolutely null and void and landlord may declare such filing
<br />a breach of this agreement.
