<br />c. The applicant shall have the burden of establishing that the <br />alternative control strategies are equal to or superior to those <br />strategies required by this chapter in meeting the objectives of <br />this chapter. <br /> <br />D. The validity of the proposed alternative strategies must have the <br />certification of a registered professional engineer practicing in <br />Texas with expertise in the field of water quality. <br /> <br />E. The applicant may resubmit strategies if the Public Works <br />Director, or his designated representative, disapproves the <br />request due to inadequate support data. <br /> <br />F. Approval of an alternate control strategy shall not be deemed to <br />constitute an addition to this chapter and subsequent applicants <br />desiring to use similar control strategies shall be required to <br />prove the adequacy of such strategies for the particular site. <br /> <br />Section 6. Certification by a registered professional engineer. <br /> <br />No plans and specifications called for in this chapter shall be <br />accepted, reviewed or approved by the Director of Public Works, or <br />his designated representative, unless accompanied by the <br />certification of a registered professional engineer practicing in <br />Texas that: <br /> <br />(1) the development plan is complete, and <br /> <br />(2) the technical and engineering requirements of this chapter are <br />met. <br /> <br />Section 7. Burden of proof. <br /> <br />An applicant for a site development permit has the burden of <br />establishing that his/her proposed plan conforms to the requirements <br />of this chapter. <br /> <br />Sec. 8. Inspection and enforcement. <br /> <br />A. The holder of a site development permit shall permit duly <br />authorized inspectors of the City of San Marcos, Texas, during <br />reasonable hours to enter onto the land, tract, parcel or lot for <br />which the permit was issued for the purpose of determining <br />compliance with the requirements of this chapter. <br /> <br />B. The City of San Marcos shall cause such inspections to be made of <br />the land or premises during development and construction so as to <br />assure full compliance with all terms, conditions and <br />requirements of the site development permit. <br /> <br />C. The applicant shall designate one (1) person or legal entity, <br />with a current address, to which notice shall be given pursuant <br />to this chapter. <br /> <br />9 <br />
