<br />that submitted as required by this ordinance showing that the <br />requirements of this chapter have not been met by the site <br />development plan for the subject property. <br /> <br />C. The City Council shall hear said appeal within fifteen (15) days <br />after the appeal has been filed and must act to revoke said <br />permit within that period. <br /> <br />D. The appeal shall be denied unless the City Council finds by a <br />preponderance of the evidence that the permit in Question would <br />violate one or more provisions of this ordinance. <br /> <br />E. Unless it is heard within fifteen (15) days, the appeal shall be <br />denied and the permit shall be effective on the sixteenth day. <br /> <br />Sec. 14. Permit fees. <br /> <br />Applications for permits required by the provlslons of this chapter <br />shall be accepted only upon payment of the appropriate fee as <br />estabilished by the City Council. Fees should be keyed to the cost <br />of issuance of a site development permit (see Appendix 2). <br /> <br />Sec. 15. Penalty. <br /> <br />Any person violating any of the provisions of this chapter and any <br />person who does any act requiring a permit under the provisions <br />hereof without a valid permit, and any person who fails or refuses to <br />comply with any of the provisions hereof, shall be guilty of a <br />misdemeanor and upon conviction shall be fined an amount not to <br />exceed two hundred dollars ($200.00). Each day that such violation <br />continues shall constitute a separate offense. Prosecution or <br />conviction under this provision shall never be a bar to any other <br />remedy or relief for violations of this chapter. <br /> <br />Sec. 16. Definitions. <br /> <br />The following definitions shall apply in the interpretation and the <br />enforcement of this chapter. When not inconsistent with the context, <br />words used in the present tense include the future tense, words used <br />in the singular number shall include the plural number and words used <br />in the plural number shall include singular numbers. The word <br />"shall" is always mandatory and not merely directory. <br /> <br />(1) Construction: Assembly of materials into a structure or <br />structures and shall also mean the rehabilitation or <br />replacement of a structure or structures which either have <br />been damaged, altered or removed or which are proposed to be <br />altered or removed to an extent exceeding fifty (50) per <br />cent of the area of said structure or structures at the time <br />of said damage, alteration, or removal. For the purposes of <br />this ordinance, the installation of parking lots is <br />considered to be construction. <br /> <br />12 <br />
