<br />Appendix F <br />Interim Drainage and Erosion Control Ordinance <br /> <br />Sec. 1. Findings and objectives. <br /> <br />The City Council of the City of San Marcos, Texas, hereby makes the <br />following findings: <br /> <br />A. The City Council of the City of San Marcos, Texas, is a trustee <br />of the natural environment of the San Marcos River, the Edwards <br />Aquifer, the Balcones Escarpment, portions of the Texas Hill <br />Country and the related watersheds for future generations of <br />citizens of San Marcos and its environs. <br /> <br />B. Development activities within the City of San Marcos can result <br />in irreparable damage to the quality of water in the San Marcos <br />River and the Edwards Aquifer. <br /> <br />C. Development activities within the City of San Marcos damage the <br />Balcones Escarpment and portions of the Texas Hill Country <br />through increased erosion, uncontrolled drainage, unregulated <br />vegetation removal and overuse of impervious cover. <br /> <br />D. The San Marcos River and the Edwards Aquifer must be protected in <br />order to preserve the health, safety and welfare of the citizens <br />of San Marcos and its environs. <br /> <br />E. The continued economic growth of San Marcos is encouraged by a <br />pleasing natural environment, quality supplies of water and <br />recreational opportunities in close proximity to San Marcos. <br /> <br />F. The City Council of the City of San Marcos desires to adopt site <br />development rules and regulations for development within said <br />City for the purpose of protecting the San Marcos River and the <br />Edwards Aquifer from the effects of water quality deterioration <br />due to pollution resulting from generalized discharges of waste <br />which are not traceable to a specific source, such as storm sewer <br />discharges and urban runoff from rainwater. <br /> <br />Sec. 2. Application of chapter. <br /> <br />A. This chapter sets out special requirements for the development of <br />land located on hillsides or in areas having erodible soils <br />within the corporate limits of the City of San Marcos, as <br />identified by topographic and soils analyses submitted with the <br />application for a site development permit, or by information on <br />file at the City of San Marcos. <br /> <br />B. Any person wishing to develop land that is platted as of the <br />effective date of the ordinance and is zoned R-l, TH, or R-2, is <br />exempt from these special requirements. All land being platted, <br />replatted or resubdivided shall comply with these special <br />requirements. <br /> <br />2 <br />
