<br />c. No new development or construction of new structures shall be <br />undertaken except on any land, tract, parcel or lot, any of which <br />is platted as of the effective date of this ordinance, and is <br />zoned R-l, TH or R-2, until ten (10) days after a site <br />development permit has been obtained from the Director of Public <br />Works, or his designated representative, for the City of San <br />Marcos, Texas. Existing structures may 0e replaced and/or <br />enlarged up to a maximum amount equal to 50% of the ground floor <br />area of the existing structure before having to comply with the <br />provisions of this ordinance. <br /> <br />D. A site development permit shall not become effective, and <br />development or construction authorized by such permit shall not <br />be undertaken until ten (10) days after the date of issuance of <br />such site development permit. The purpose of this ten (10) day <br />delay is to allow time for the appeal of the issuance of such a <br />permit and to avoid potential financial losses from a decision to <br />revoke the site development permit. <br /> <br />E. No building permit shall be issued prior to approval of a site <br />development plan and issuance of a site develoment permit for the <br />subject property except on property where a plat has been <br />recorded prior to the effective date of this ordinance and zoned <br />R-l, TH, or R-2. <br /> <br />F. No clearing or rough cutting of vegetation, or grading or <br />scarifying of the top soil shall be permitted on any parcel of <br />land without a site development permit, except when: <br /> <br />1. The clearing of underbrush and the maintenance or removal of <br />individual trees is on a parcel of land where development has <br />already occurred, provided, however, that said clearing or <br />removal is not for the purpose of construction. <br /> <br />2. The clearing of underbrush and the trimming of trees is <br />necessary to allow sufficient access to the entire property <br />for planning and engineering purposes. <br /> <br />Sec. 3. Application for site development permit. <br /> <br />A. Any person desiring a site development permit shall submit an <br />application to the Director of Public Works, or his designated <br />representative, on a form provided by the Department of Public <br />Works. The application shall be accompanied by a site <br />development plan. <br /> <br />B. The application and the plan shall contain the following <br />information: <br /> <br />(1) The date, scale, north point and key plan showing the <br />location of the tract on which the development is to take <br />place; <br /> <br />3 <br />
